ROC 3 cards with different dates

Hi!

 

I finaly got my kids GK and started making notifications in phone, computer, waslls, fridge - everywhere (my memory is not good) to avoid loosing moment in two years. 

 

So, my situation - my card was approved and valid till April 2, my kids' cards are valid till June 15 ( I came with K1, they K2). So my "gap" starts January 4 and finishes April 2. Kids Gap starts March 18 and finishes June 15. 

 

So I am planning dates and my question - is it better to send all cases together? or they will collect them together later if I send it separately?

 

If they will just receive case from March 18 till April 2 (its gap where we all can send our cases) but open it after April 2, would it be counted as I file it too late? or it is needed to be delivered in that gap?

Hi,

Since   you and your kids acquired conditional resident status  within 90 days thereafter,  you should submit ONE  I-751 petition. Just include kids' names and their  A-Numbers in Part 5 of your I-751. And check the box that they apply with you.

And I believe you can submit your Petition any day within  YOUR window  - you don't have to wait for children's dates. Petition will be YOURS, kids are  derivative applicants anyway. 

 

USCIS usually  goes by Post mark . Not by the date they opened the package :)  So,  for peace in mind you can submit the Petition on March 18. As long as it's received by USCIS before April 2,  you should be fine.
