We sent off our petition yesterday and my boyfriend missed the part where we were supposed to copy both sides of his birth certificate and all of his passport in colour. We just photocopied the writing side of the birth certificate and the part of his passport with his picture in black and white. :( We won't even get this RFE for months but I could kick myself since it's not even been 24 hours since we posted it and it was the one thing I didn't check because he seemed so sure about what was needed. I did check the USCIS website and I can't find where it specifically states this rule. 

 

Should we expect an RFE in some months time or is the front and back and in colour just a preference? If someone could point me in the right direction as to where USCIS specifies this I'd appreciate it and I guess we can get it all sorted to send it off the minute we get the RFE

 

Thanks in advance for reading this and any replies, it's greatly appreciated. I'm just panicking now at the delay this could potentially cause.

If you get an RFE, it would be soon.  I don’t know if either will necessarily hold things up, because you bring the original documents to the interview.  I wouldn’t get upset, it would be an easy reply if you get an RFE and it wouldn’t hold things up.

Congratulations on your filing! 

 

We never sent copies of birth certificates with our I-129f application, only scanned copies of our passports.

 

We also paid to have an Immigration lawyer check our application before we sent it and there was as no mention of birth certificates.

Hi there! My hubby never sent photocopies of any of his passport (it was in some unknown, mysterious place at the time). My belief is you will only need one proof of naturalization/citizenship. As for the birth certificate, others will be more helpful as he sent in an original certified copy to USCIS and we received it back one month before our approval.

don't worry too much RFE is not too bad and it wont hold your petition up too long. we got RFE and we got approved 2 weeks after we submitted what they asked.

we can wait for months so 2 weeks don't really matter :)

I believe you will be fine.  The need to photo copy the blank side of a birth certificate and include copies of blank passport pages I believe are two of the biggest VJ myths.   It has been a very long time since I have seen anyone report an RFE for not including a copy of the blank side of a birth certificate or unused pages from a passport.   For proof of citizenship, only one of these two documents is required, but there may be other reasons to include both, for example to show passport stamps as evidence of meeting the two year visitation requirement.

 

Personally I included only copies of the front side of my birth certificate and the bio pages from my passport and passport stamps.   I am a December 2017 filer, so within the next month or so I should know if the adjudicator had any issues with my submission.

With the submission of the I-129F, either a copy of the petitioners birth certificate or copy of the petitioners passport is required for proof of the petitioners citizenship.    During Embassy Interview, the beneficiaries passport is presented during the interview.

 

It is possible the  Embassy would want to see the petitioners birth certificate, but I have not seen that mentioned before, but each embassies requirements may be slightly different. 

 

Any possible RFE's would not appear until during adjudication of the petition which is currently taking about 6 - 7 months after submission.   But I belief there will be no issues for the original poster here with this.

Hi! Don't worry about it! This exact same thing happened to us. We also sent only the short form birth certificate and the info page of his passport. I was so anxious and thought we would get a RFE but we got approved without any problems. Some adjudicators might let if fly but some might not, so if you do get an RFE it is an easy fix, just have your documents ready :)
