CR1, but in the US?

You can file the I-130 anytime. ETA: ~12-16 months, so you'll have plenty of time in the US for domicile not to be an issue.

 

That said...if you both live in the Philippines, you can do DCF instead. ETA: ~2-3 months or so. You would file the I-130 with the US Embassy in Manila (USEM) instead of filing it in the US.

Is there no other way I can be with my husband in america within this year? Any advice? 😞

DCF would be the fastest option by far, if you qualify.

Beyond that, no - unless he qualifies for and obtains some other visa that allows him to stay in the US, but no other family-based visa is faster.

As long as you as the petitioner (you) have residency in the Philippines you can file the DCF there and then you can leave to the US.  Like others have said it can take 2~3 months.   That's the fastest way.

Citizenship or nationality won't be a factor, but actual residency there would matter. Contact USEM for details on what exactly they will require (specifics vary by embassy).

The combination of Philippines Citizenship, US Citizenship AND currently residing in the Philippines is plenty to assure she qualifies to file DCF.  Start here.  https://www.uscis.gov/about-us/find-uscis-office/international-offices/philippines-uscis-manila-field-office

I'd go just by the residing in the Philippines part of it, but I concur that it sounds like DCF applies here.

There are some specific hoops to jump through as only a "resident" of the Philippines that can be totally skipped by being a Philippine/US dual citizen.  For example, I've lived in the Philippines more than six months.  If I were married and wanting to file DCF (I'm neither.) I could do so, even though I'm just constantly extending my tourist status.  I would submit my lease and Sky Cable bill instead of a visa that allows me to "reside" in the Philippines and then it would be a judgment call in my favor.  The OP, being a Philippine citizen, doesn't need to jump through that hoop.
