Hi, I am on L2 Dependent Visa and applied for EAD in california center. I have received mail to submit additional below documents.
1) Principal's Current i 797 approval notice for form i 129 - Do i submit both 797 and i129 form 
2) Employees Current Pay Records - Can i submit just the pay stubs and if yes, how many pay stubs
3) Employment Verification Letter - Is this the company letter stating that employee is working with their company
4) Federal Income tax Returns - We moved in March 2018 hence my wife doesnot have Tax Returns. How do i respond on this?
5)W2s - We moved in March 2018 hence my wife dont have W2 from the employer . How do i respond on this?

1) The i797 approval notice only

2) 3-6 paystubs and 3-6 bank statements showing the paycheck going into the account

3) Letter from the employer should be on company letterhead and state salary, position, time with the company and (if possible) prospects for continued employment in the near future

4) I am not sure what moving has to do with tax returns. If you should have filed tax returns for 2017 then you should have filed them. Period. Moving is not an excuse to not pay your legally-required taxes. 

5) ditto. She should have received her W2 by end of January anyway. If she doesn't have it, call the employer and request it, they probably can give it to her electronically. Why do you think moving is a good excuse to not get her W2 and pay her taxes?

Thank you for detailed Response. I am good with first 3 questions now.

 

Last 2 points, we have moved to united states and started working from March 2018 and we were in india until Feb 2018. Hence neither us nor employer would have the Income tax file returns/W2 of United states. With this, do we have to just write a note saying we dont have the documents with the reasons?

I see. You moved TO the US. That wasn't clear. She is not a US Citizen and did not live in the US in 2017? Yes in that case she would not be expected to have a US tax return. They made a mistake and I would simply write them a letter clarifying your situation. Maybe include your I-94 history from online as evidence of when you entered the country.

Hi,

 

I am on L2 visa and applied for my EAD at California Center - we have moved to US in July. I have received RFE asking for same documents. PLease share your insights on the same - esp for last two docs ask. Did they accept? What exactly you shared?
