Can I remain in the US during GC processing?

Hello everyone,

 

I'm here on student F1 visa and got married to a US citizen. We submitted my AOS application (I485, 130, etc.) last week. I am planning on not continuing with school at this point, I want to go back to school after I get my green card, which means my F1 visa might be terminated if I won't enroll in school. I am wondering if it is ok? Any body has any similar situation/experience? Thanks for sharing.

A properly filed I-485 grants authorized stay, so you can remain in the US while it processes.

In fact, if you leave the US without AP or a green card, you likely won't be let back in and the AOS application will be deemed abandoned...forcing you to go through consular processing for an CR-1 immigrant visa abroad.

Thanks Geowrian, so does it mean I'll have to wait until I get the receipt confirmation from USCIS, and after that I can stay without enrolling in school? Our package was delivered but we haven't heard anything yet, it's been 4 business days.

Technically, once you file you are good. But I would suggest waiting for the receipt notice before taking any action to ensure the packet was accepted by USCIS.

Thanks again Geowrian. I am still anxiously waiting for the receipt.  Btw, I know this might be off topic, but I was wondering if I needed to submit all I-94 records or just the latest one? I traveled back and forth between US and my home country very often, so I don't keep all the I-94s, and the website only generates the latest one.. I prepared the package myself. The instructions on the forms were pretty straightforward, I was only concerned about the supporting documents whether they are enough or something I might have missed.

The same website has another tab for History..it all generate the I94 history for the current passport for the last 5 years.. not always totally complete but a good record of your travel dates 

Hey Dee Elle, thanks for the response. I had tried that but it said No history for this traveller. I also read some other forums and people said that I only need the latest I-94, thats why I didn't try requesting for the travel history since I will take a while and delay my application submission. But I'm not sure if I should request and submit to USCIS as a supplemental document now...

Only the latest I-94 is necessary for AOS.
