Hey. So I'm from the states and my fiance is from London (a UK citizen) and I'm trying to get her over here on a K1 fianceVisa. I'm 22 years old and just got back to America a few weeks ago(I was living with her in London the past 6 months on a visitors Visa just cause long  distance sucks). Before I left, I was a full time college student & did not meet the income requirement. Now that I'm back in America, I just got hired at a job that does meet the income requirement. My question is, since my w2s and tax statements from the past 3 years will show that I dont meet the requirements, should I still put them in my application or can I just put my new pay checks in the application that shows that I'm now meeting the financial requirements. And if so, how long should I wait until I send in the application? Like should I wait 2 or 3 months and show them 2/3 months of my recent pay checks or do I need to wait longer. I was hoping to just show a few recent paychecks so that we wont have to wait so long to send in the application, know that the application process is already long in itself. Lastly my dad does & has been making the financial requirements & is willing to help me sponsor her, so should I use his pay as well as my pay, instead of my pay, or do you think I'll be fine doing it on my own with my paychecks. I'm not sure how far along in the process, but I'd suggest studying up on the guides here. You do not need to put any financial information into your initial K1 application. When your fiancé reaches her interview point, you will send the financial support form and any supporting evidence to her. She will take this and any other required documents to her interview, where the officer will review them directly. For London specific cases you do not need 3yrs worth of tax returns. 1 most recent tax transcript will suffice. They are also very easy about what they will accept as further evidence. Pay stubs, w2s, bank info (if you are using assets only), or the most popular - a employer letter. They even accept self-sponsorship for those foreign fiancés that have a significant amount of savings/assets. For K1 cases in London you also wouldn't be combining finances with a co-sponsor if you ever decided to use one either. You either use a cosponsor or you do not.

 

When we used our cosponsor, we provided the officer with the most recent tax transcript and an employer letter.

 

If you use a cosponsor for K1, only the cosponsor will fill out the required form and evidence (a few officers recently have asked for the form from the American fiancé aswell regardless of if they make enough or not). London has no problems with cosponsors and are fairly easy with evidence. We used a cosponsor throughout our entire process.

 

Once you have the visa and marry in the US, you will need to file for adjustment of status. It is during that process where more strict rules about financial documents come into play (and it also gets sent in the same packet). But even there you may choose to use a joint sponsor only (this time though it is required you also fill out your own form as well as the joint sponsor), or you may elect to then combine incomes if you want depending on what options work for you. Requirements regarding having tax transcripts are also more important.

Okay thanks! We literally are just starting the initial steps. Do you remember how much it cost for the initial application? And I only need my info (passport/vital documents) not hers at this stage correct?

For every question I've ever had throughout this process, I've found the answers here. Either by browsing the forums, asking the incredible members for help, or by following the guides that are linked at the top.  When we filed, the initial cost was $535 but it is always subject to change. Oddly enough, when we did our interview last week, the US embassy in London only wanted to see a letter from my employer that verified how much money I made and that I held a full-time, permanent, position.  They didn't ask for any other documentation to prove my figures.

I'd also encourage looking over the instructions of the form provided by the USCIS carefully.

It's $535 for the application.

There will be other fees later on. Such as paying for the actual visa, the cost of the medical, and any vaccinations required.

 

This thread should also clarify some specifics regarding London cases. A few items are out of date, but read through the thread for any new bits and pieces of info. It's still very helpful.

To be on the safe side, I'd bring an employment letter and also have your dad acting as a co-sponsor. That way, in case your employment letter isn't sufficient enough, you have a back up plan. You won't have to show financial proof until the interview so that will give you many months of paystubs by that time. I wouldn't put off applying. The wait time is already longer than normal.
