Every entry of a non-immigrant is at the discretion of CBP, and even LPRs are not guaranteed to be admitted (they can be paroled w/ or w/o detainment).

Just visiting at the frequency he has noted is not likely to result in a bar. It could result in a denial of entry and a withdrawal of application (and likely invalidation of his ESTA afterwards), but so long as he is honest with CBP, the risk of an expedited deportation is very slim. Many people visit for over 90 days over a 2 year period just fine. A general rule is to spend more time outside the US than inside it...spending twice as much being preferred.

I think I'm being responsible by conducting as much research as possible and trying to establish what is fact and what is arbitrary. It's like your approach to split the 90 days allocated 45 days each year and use sparingly. That is totally made up by you following a rule that doesn't exist. I have a history of entering the US and leaving after a short space of time e.g. long weekend or a week or two. This pattern is established naturally due to working in the EU and finding time/ money to visit. No-one would look at my visits and think that I work in the US or I'm not going to leave. The 90 day consecutive vs cumulative threw me at first but I am now comfortable that my visits are deemed reasonable and not on a knife's edge. There are no guarantees but I can validate my visits.

Ok. I get your reasoning but don't insult me. I am your age. I have 2 children. You are risking being denied entry to the US. Your baby is due next month. 

It doesn't matter what I think, or what I say. What matters is the customs officer in the US having the power to deny you entry. 

That officer has the power to deny you entry. You are powerless to have any influence over that. 

All the credentials you think you have are meaningless. You are risking your girlfriend giving birth to your child alone & you potentially being barred from visiting them for the foreseeable future. I don't care what you think about me. I have ensured I've done the right thing by my family. You need to research, do the work & then if you have questions come back & ask them. Please stop wasting time of this supportive community. It has taken how long? to get clarification from you.

Arguments within arguments aside. I think it's important that people who aggressively defend a position that is clearly wrong should look at how they are hurting people who are trying to put together a plan. I'm not talking about opinions or lifestyle choices or how risk taking they are but defending the opinion that is based on rules that don't exist.

 

I woukd love to be able to help out people but if I felt angry or persecuted then maybe forums aren't for me.
