Oh so the petition is the K1 visa we applied for and that was approved but the AOS is not a petition and that was denied because they thought we abandoned it correct?

The petition was the I-129F, which is what established the relationship allowing her to apply for the visa (and also the underlying petition to enable filing for AOS).

But the result is the same...the petition was approved and AOS was abandoned.

When answering a question on an immigration form, do not abbreviate "Adjustment of Status" as it is both an abbreviation only used here, to refer to either Adjustment of Status or Affidavit of Support.

Correct. I wasn't suggesting using the term "AOS" on any forms. :)

I understand that. The danger is that the OP doesn't and actually uses your answer on a form.

Hey Guys is this okay for the question we were unsure on?
Is this the correct way to go about it? Will it be sufficient?

Our Answer will be on the addendum shown here, also we will attach scanned evidence of all the correspondence with the officer and the letters we received?

Part 5. Have you EVER previously filed a petition for this beneficiary or any other alien?

                                                                    Addendum 3 to I-130

The Addendum Refers to the following:

                               Question:

Reason for Explanation

Have you EVER previously filed a petition for this beneficiary or any other alien?

Yes, please see explanation. We want to give the most detailed response we possibly can and have attached evidence.

I have filed a K-1 Petition for Alien Fiancé for my husband when we were engaged, which was approved and we went through the subsequent process. Then we came to the Adjustment of Status stage which we filled for on 10/03/2016. We were then called for the Adjustment of Status Interview which we were approved for but had a RFE regarding: Vaccination History being Incomplete.

Reason for RFE: Vaccination history was incomplete. “You must complete your vaccination with an authorised USCIS civil surgeon documented on form I-693”.

We got that done in the time frame we were given and sent it back to the USCIS office but we regrettably left out the paper that identified our case with the RFE we sent back.

While this was going on we were moving apartments, We attempted to accomplish a Change of Address online and thought we were successful in doing so, but we were shocked to find out later that I the Petitioner could not change our address only my husband the Beneficiary could be the only one to be able so. Thus resulting in the Change of Address being rejected and the address remained unchanged. (We found this out after the fact)

We waited to hear back from the local USCIS office and we waited and waited. The 30 day period that we were given to get the Request for Further Evidence back to the local USCIS Office had passed and we called to check up on if they had received the package.

We were notified that they did not receive the RFE and a notice had been mailed. We waited for the notice, (It was sent to the old apartment). We went rushing to see if they had it at the old apartment, they did not.

We called again to find out where the notice was and we were informed about the request to change the address had not gone through and that is the reason the notice was sent to the old address.

At this point not only had the 30 day period we were given had elapsed, the period to appeal or re-open had also passed us by. Leaving us waiting on the notice at our new address that came soon after we finally got our address changed. The notice said my husband’s Period of Admission as a K1 Immigrant had expired and you must begin making arrangements to leave the US because the local USCIS office had not received a response from the RFE. So therefor the petition was considered abandoned and the application was denied. My husband then left so we did not ruin our chances of immigration success in the future and we immediately began filing this petition.

Please See Attached Evidence of Notice

@pushbrk Hello Sir!

Do you think this is okay for part 5?

Your feedback is greatly appreciated!

Alternative:
Answer Approved and then just add an explanation sheet of why we are in the situation we are in?

Your letter is a bit wordy but OK. It should begin as "I filed" not "I have filed" but otherwise it's fine.

There is a scanned letter still in this thread with the OP's full name.  This should be removed.
