Timeline

What exactly was denied?  If it was the I-485 only and not the I-130, you do not need to file another I-130.  What is the status of the I-130 itself.

I think you mean removal of conditions, not adjustment of status.

First, please blackout or otherwise mask any personal information, case numbers, etc. This is a public forum.

 

Second, you entered on a K-1 visa and did AOS from that. As such, you never filed an I-130...you used an I-129F. So you will need to file an I-130 now.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

So yes, this is the reply we got. Back ground story:

We went for AOS interview and was approved but the officer said my medicals needed to be signed off on.

We got that done, he gave us a piece of paper with instructions, on the paper it said place this paper in the package. 

We had 30 days to do so. I thought I had done it, but I forgot the paper in the package. That paper identified our case with the package. 

Therefore they did not identify the package with our case so they said. 

Then the 30 days went by.

In this period we had moved address' and we thought we had changed address'

My wife was not allowed to change address, they said. So that added more time as the people on the phone were not much help.

Then time went by for the notice to get to us and we had no time to appeal, the period to appeal had already gone.

Naivety, stupidity, fear all in one I guess.

While I cannot comment on whether you have other options other than filing for a CR1/IR1 from overseas, I hope you realise that your paperwork must be in order if you want your case to proceed smoothly. 'Thought I had done it' should not be something that happens at all in your next step. My husband and I live on almost opposite ends of the planet. We have a 13-14 hour time difference. I am the one who's good with paperwork but he's the one who has to assemble packages and send off the papers. We have had to be meticulous at every stage to ensure all papers are submitted, all forms filled in correctly etc. so we got no RFEs nor checklists. It takes us up to 3 weeks to put a package together because everything has to be checked thoroughly. Immigration is not something you can hurry or rush through, or you will just end up prolonging your separation.

 

Whatever your next step is, study very carefully every single form. Read every single word of whatever instructions there are. Search this forum if you have questions. Good luck.
