My husband is convincing me to go to him. He is saying that i write it by law that I will not divorce and harm you in any way. So by law it can be done??

No.  There is no way to have a valid agreement that forbids a divorce.  No court would force him to stay married and can not have a divorce if he changes his mind. 

He can't send you back; that's not in his powers.  The US Government can revoke your green card.

 

Paperwork is not going to protect you from getting harm.

You are scare of him, yet you will stay with him go to be with him for a green card.  How does this make you look now?

NO.  NOT LEGAL.  NO COURT WILL FORCE HIM TO STAY MARRY IF HE CHANGES HIS MIND AND FILES FOR DIVORCE.  ABSOLUTELY NOT.  NO COURT WOULD ORDER A PAYMENT PENALTY IF HE DOES NOT WANT TO STAY MARRY TO YOU.  AMERICAN COURTS DO NOT FORCE PEOPLE TO STAY MARRY.

If he hurts you (physically), he could even end up going to jail but that doesn’t mean he wouldn’t hurt you if he wants to. 

 

It just feels like there are pieces missing in your story. You come to your parents place on your husband’s petition based GC claiming he is cruel, you seek advice on how to return GC while securing unchecked future travel to US and now that people are suggesting your future travel isn’t guaranteed, you want to go live with your husband if he signs on a paper that he doesn’t hurt or divorce you!! Judging by what you have said so far, it does feel this while marriage was for immigration purpose only.

 

Back to your questions again, if you really think he is cruel and he is a threat to you, no matter what he signs on or says, you don’t wanna go live with him.

1)  Any letter like that is not worth anything.

2)  Any letter like that is not legally binding, meaning it doesn't prevent your husband from divorcing you or harming you.

3)  Any husband who comes up with the idea of a letter like that is probably just trying to play with your mind.

4)  Any attorney who actually writes a letter like that or thinks a letter like that will prevent anything is not a good attorney.

Your husband threatening to report you for fraud is abusive. Don't allow his intimidation to get at you. You have rights. Speak to someone at the hotline, they will be able to tell you where to go for advice if they don't know themselves.

Her husband saying that she is a fruad isnt wrong, he sponsored her to come to usa and she went to live with her parents, how do you call that?, it is clear she use the usc to come to usa to live with her parents.

Sorry, but it is clear your husban is right, you are a fraud and yoy only used him to come to usa, look how you are looking any way to stay at usa,

I took my oath ceremony in Indianapolis, it was a nice ceremony, where people from 35 coutry become american citizen.

Wrong? Clear? I try not to judge without the facts.

I don't presume to know how it feels to be raised in another country with different customs and expectations. Maybe OP didn't know that what she did may be considered fraud in the US.

I was responding to someone saying they feel scared and don't know what to do. I was providing information and signposting. IF anyone uses their spouses immigrant status in an attempt to coerce them that is abusive. That is why USCIS send a pamphlet about abuse and your rights as an immigrant to all approved cases. Why would they that do that? Because it is a problem and happens enough times that they recognise it is a problem.

Unless some threat was made between when she got on the plane and when she decided to live with the parents, I can't imagine a valid VAWA circumstance. It really looks like they used the visa to enter the US to live with the parents, abuse or not. For a valid VAWA claim, one must not only show abuse, but also that they entered the marriage in good faith. That second piece is the one that sounds near-impossible given the facts.

 

Edit: Sorry, looks like they already have a green card so VAWA doesn't apply...just ROC with an abuse waiver. But the rest of it stands...just not VAWA specifically.
