Hi everyone

 

I just needed some clarity regarding the K1 fiancé visa cancellation process.

 

See, last year we applied twice for the K1, and while it was granted the first time after 5 months, we were going through some struggles and decided not to go forward with it, then after moving to the US as requested from my fiancé we applied again, but unfortunately after six months living together it turned out not to be what we both really wanted and hoped for.

 

While we are currently trying to keep things casual and friendly, the second application is still running, and I was wondering how would that affect me since I’m a Spanish citizen that often travels to the US to visit friends or on holidays, and now I’m affraid to even plan a trip since I’m not sure how would that affect me.

 

It’s now clear that we won’t get married, but I’d like to still be able to visit friends or go on holidays, so I wonder if it’s advisable to have him cancel it or do it myself (not sure if that’s even possible), I’ve read such cancellations could really hurt any other visa requests, and while I still have a tourist and business visa for another 5 years, I wouldn’t want to have any troubles in the future simply because of a failed relationship.

No, last year we started the process and got it granted but we decided to let it expire since things were not clear between us. After that initial petition expired I visited for little less than 6 months and left the US after we both agreed not to do it, but we haven’t received the resolution over the second petition.

Have you overstayed your visa?

I didn’t move to the US, just visited for few months, and no, I didn’t overstayed.

Just have your ex cancel the pending petition. That's it. It's better to cancel it than let it expire again.

Sorry for the misunderstanding, the idea was to “move” there until the process was over and then carry on with the wedding after a brief return to Europe for the interview etc, hence why it mentally felt like a move, but I just entered under a tourist visa then, with no overstay.

what is the difference between a cancellation and letting it expire?

 

and also, do you have any idea how long would the cancellation process would take or if I could still travel as a tourist?

Main thing is the USC has to write into USCIS and ask for the withdrawl/cancellation of the petition. The beneficiary can't.

08/15/2014 : Met Online

06/30/2016 : I-129F Packet Sent

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

How long it takes exactly is unknown to me honestly; but cancellation is best way. There have been stories of people letting the petition expire, then 2-3 years later they go through the K-1 process again with someone else only to find that the original petition is actually somehow still active in the system.

Yes, I guess is the right thing to do, I just wanted to check if I could do this on my own since the subject is still delicate between us and we are trying our best to make the most out of it without hurting each other, but I guess we’ll need to have that conversation, hopefully helping us both move on.

 

Thank you so much. I’m guessing my chances of traveling to the US as a tourist remain valid then?

If things were/are not clear, cancel the petition. It's a waste of time for them and for others who are actually waiting to be processed and interviewed if you just let it expire. 

 

I know it might do nothing here but when I was waiting on my K1, I kept seeing people saying how in the middle of it they would not appear to the interview or they would just let the visa process keep its process and then when it arrives to the embassy call it good and let it expire. To anyone who might think about doing that, DON'T DO THAT! There's people who is sure of what they want and a lot of times we have to wait longer because of people who does not cancel it and give space for other applications to be checked and go through faster.

Nov. 2016 - Applied for K1 Visa
Nov. 2016 - NOA1 

April 2017 - NOA2 (6 months!)

April 2017 - Arrived to NVC

April 2017 - Got the # from NVC

May 2017 - Case left NVC

May 2017 - Arrived to Embassy

May 2017 - Got Package 3 

May 2017- Got Package 4

May 2017 - Interview [APPROVED!]

June 2017 - Visa arrived home

June 2017 - Made it to the US. Finally with my future hubby!!

July 2017 - Married!

AOS Process

August 2017 - Started AOS

August 2017 - NOA1

Sept. 2017 - Biometrics

19th Dec. 2018 - Interview date  [16 months]

Dec. 2018 - GC processing

29th Dec. 2018 - GC arrived home! [10 days!]
