Hi,

 

I got the RFE letter about my i-864, saying my sponsor's income does not meet the poverty guideline. But according to my calculation, it should. 

 

I submited the application in 2017. My sponsor's income of 2016, which includes SSDI(social security) and salary,  was $12000. if plus my bank saving over 12 months, five times to fill the gap, it should be over the poverty guideline.

 

And, my sponsor's income of 2017, which includes SSDI(social security) and salary,  was over $21000. We mail the W2 of 2017 too. 

 

So, I don't know why it is still not enough. Shall I go to InfoPass? Will it make any change? Or, I'd better go to find joint sponsor to avoid wasting time and effort.

It depends on what sort of evidences of current income of your sponsor? The RFE is generic. Even if one item is missing, they simply say income was not sufficient. List what you provided initially to get better suggestions.

I think I have provided all the necessary documents. 

 

Tax receipts (2016 and 2014) - no 2015 because it was not filed.

Social Security Letters (2014 to 2018) - prove the income from SSA

Bank Statements 

Paystubs of last 6 months

 

I even submitted W2 of 2017.

 

My question is if it is worth going to InfoPass. Will they give me the explanation? When I called USCIS, they said the case is processed by the center office. The local office(infopass) knows nothing about my case. Just to what the RFE asked for. I am so frustrated.

It could help getting the infopass and taking with you everything you submitted so they can tell you in their eyes why they think it wasn't enough or what more you could do. IT could just be a simple issue of there not being the RIGHT KIND of proof. 

 

Now, I don't want to be alarmist, but I wanna share our experience. Our original joint sponsor's only income was SS retirement income and VA disability. We got a boilerplate RFE saying he didn't meet the income requirements, even though he did by far. I talked on the phone with a couple of USCIS immigration officers and one of them just cut me off and said that those types of income don't count as income at all. Alarmed, I read aloud their own memorandum that says that SS/VA income that's NOT means-tested IS allowed. The guy ended just saying "oh, well... if you are reading it from there then you are right..."  Because his response didn't sound convinced, I talked to various people here on VisaJourney that had gotten their sponsors approved with the same benefits, and they all confirmed they WERE ALLOWED. Since this was all contradicting, I did an infopass and the person there helped zero. She said our paperwork looked ok and didn't know why it was not enough, she didn't look like she had any idea if the benefits counted or not, and then just told me to just provide the info the RFE was asking for, but there was just no more evidence to give. 

 

In the end, we were so scared that whoever was handling our case wasn't gonna be convinced of the income, that we just got a different joint sponsor that was "normal", with just a salary, no SS benefits.
