I'm on the border between June and July; (mailed June, approved July 3rd). My case was transferred to Potomac on the 10th May and it's been quiet since. It seems to be roughly 2 to 3 months between a transfer and some movement based on various comments in threads related to cases earlier in 2018.

Hello Guys , I have a quick question and I'm kinda worried! So my GC has my First and Second name, my two last names and my husbands last name (it's pretty long!) That's how it was issued once we got married abroad 

 

But my concern is... for the proof I initially sent on july of 2018 my joint Bank statements and joint Credit card statements only show my first name, middle initials and my husbands last name due to the fact that branches told me that they couldn't fit my complete name on our statements or the physical credit/debit card but they all have the same address so that's how we get them every month ever since we have been together here in the US 

 

Could I get a denial because of that or a RFE ? Please help !

My current situation: 

 

1)  Filed I 751 Jointly in July 2018.

2) I filed domestic voilence and divorce against my wife in August.

3) I got divorce in September 2018 under "Cruel Treatment" category, i proved in the court that my wife tortured me.

4) During this time, my wife called USCIS and told i left her, but didn't withdraw the I-751.

 

 

My question

1) I asked my lawyer about next steps, he told me to wait till the decision on my current jointly filed I-751.  He mentioned i don't have to inform USCIS about divorce. Is it correct ?

2) Since my wife called USCIS and told them i left her, i am assuming i will be definitely called for interview, so in the interview if i directly show them final divorce decree i got under cruel treatment and the proofs we entered marriage legally, will they approve my case ?

I'm very sorry to hear about your situation. Based on my understanding of the 751 instruction and to answer your questions:

1) You DO need to inform USCIS once you get the final divorce decree, send USCIS evidence of bona fide marriage and partner violence, and switch the joint filing to divorce-waiver filing. You should be able to keep the dates of original filing.

 

2) Relating to question 1, you need to send the divorce decree as soon as you get it and switch the case to divorce-waiver, definitely before the interview, if there is one. In the meantime, gather evidence for bona fide marriage as much as possible. So if there were to be an interview, you'll be prepared.

On the other hand, I'm just so curious. Usually it's the men who abuse their partners, cause men are often physically stronger and possess more social resources? Domestic violence is a power issue, and I just rarely hear cases that women abuse men. No offense or questioning your situation, just curious.

I had a few supporting documentation that were also still with my maiden name. I just added a note in the cover letter I sent when I filed my I-751 and where I described each document that was being attached, mentioning that such and such document were issued with my maiden name. I assume this is understandable and should not be an issue as certain documents - no matter how many times you ask to the entity to correct your name - it still appears with the maiden name. Pretty common issue and again, shouldn't be an issue per se.

Thanks for the response, good to know it's a common issue. Companies should allow 40 or more characters to be added on statements *sigh* my joint bank, credit accounts and married filled tax returns have that issue. It's funny how the IRS has that issue (our tax return was accepted)

I received two notification as well, one on June 7th and another one today June 11th. The wording is slightly different:  

 

On June 7, 2019, your Form I751, PETITION TO REMOVE CONDITIONS ON RESIDENCE, Receipt Number WAC1890394099, was transferred to another USCIS office. That office now has jurisdiction over your case. We sent you a notice that explains why we moved your case. Please follow the instructions in the notice. If you do not receive your notice by July 7, 2019, please go to www.uscis.gov/e-request to request a copy of the notice. 

 

On June 11, 2019, we transferred your Form I751, PETITION TO REMOVE CONDITIONS ON RESIDENCE, Receipt Number WAC1890394099, to another USCIS office. That office now has jurisdiction over your case. I received same message and same dates. Not sure why it was transferred twice?

I was notified twice too on myUSCIS account (transferred on May 20 and May 22), but I've only received one letter so far.
