Hello,

So I received a RFE the beginning of May for the latest tax documents but they still haven't put anything on the IRS website. My husband called the IRS yesterday to see what he can do and they've told him it will take 6 weeks to process it, but I don't have time for 6 weeks. Right now we're thinking of sending the tax returns, employment letters, pay stubs, bank statements, and a letter explaining why we don't have the tax transcript yet. The RFE said they'll make a decision on what we send so I don't want to make a mistake, did anyone go through this? What should I do? Is there more of an official way to send tax returns?

Does the RFE specifically ask for the trancript? I don’t think so. If trancript is not available, you can send the tax return documents (copies of what what you sent to IRS including W2). If you did the e-filing, you can download the documents from wherever you e-filed.

We sent tax returns for 2016 instead of transcripts when I filed in December 2017. I thought the reason I got a RFE was because I read on visa journey that the uscis don't accept tax returns.

Is RFE is saying particularly for tax transcripts or just says "latest documents" i think you should be OK sending W2 and 1040 Returns for 2017.

 

It says the transcript is not available on the IRS website. The RFE only says latest documents.

We had an RFE for "proof/evidence of income" on March 26  (actually, they said we had not included any financial info for the I-864, which was not true---lawyer included tax info for husband (main sponsor) and his parents, which are co-sponsors). For the original package we had included the 1040's and W2's we used to file our taxes via online software for the 2014, 2015, and 2016 tax years. This year, we had filed our taxes early, via online software, married filing jointly, so we included that for the RFE (plus husband's pay stubs, co-sponsor's income info again, and a detailed letter written by lawyer stressing that everything had originally been included, but here it was again, with some additional documents. On myUSCIS, they updated on April 24 saying they had received our response and taken the case off hold (as of May 30, it's moved to "Ready to schedule for interview" so I think the reply was sufficient). In summary, the 1040 printouts and the W2's worked in our situation just fine, no transcripts were used. I'm betting, as others have said in this thread, it would work for you too.
