On the I-129F there is a section "Multiple Filer Waiver Request Information". This doesn't apply to me, so I thought I just leave it unmarked, but the last checkbox states "Not applicable, beneficiary is my spouse or I am not a multiple filer".

 

Do I check this box, or leave it unchecked? It's confusing, because the last portion does apply to me, since this is my first time filing/I'm not a multiple filer.

Im too a little confused about this question because Iam not a multiple filer, and nor is my Fiance my spouse...shes is my fiance..

 

This question doesn't make much sense in regards to a K1 Visa I-129f petition because its a Fiance Visa.. There for the "Beneficiary is my spouse" doesnt pertain.

This form can also be used for a K3/4 visa with is for a spouse.    Hence the "spouse".

An I-129F for a fiance/fiancee does conditions in which a multiple filer waiver is required. Namely:

Quote

1. You are filing this petition on behalf of your fiancé(e) and you previously filed Form I-129Fs on behalf of two or more fiancé(e) beneficiaries; or

2. You are filing this petition on behalf of your fiancé(e), you have previously had a Form I-129F approved, and less than two years have passed since the filing date of your previously approved petition

So if either of those conditions are true, you do need a waiver.

Note the wording on 5.d.

Quote

Not applicable, beneficiary is my spouse or I am not a multiple filer

If no waiver is required OR your beneficiary is your spouse, then you mark that box.

 

An I-129F can apply for a spouse (for a K-3 visa). K-3 visas are basically obsolete now, but they exist in the law until they change the law, so they have to still support filing the forms for it. The form they use (alongside an I-130) is an I-129F.
