CR-1 after K-1

Rose and I are now married.  The documents have been sent to PSA.  They told Rose to check next week to see if the marriage is recognized there.  They also said it would only be about 2 weeks before she receives the marriage certificate.  I assume it will take longer but I am going to start the paperwork now.

 

First question is whether or not I need a waiver since this will be the second visa applied for within 2 years.  Also, do I need to formally withdraw the K-1 or did the refusal do that for me?

PHILIPPINES ONLY!!!  CFO (Commission on Filipinos Overseas) INFO - Can't leave home without it!

 

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.

Thank you. It isn’t always easy but I know that the end will justify the means.  Whatever I have to do to be with Rose I will do. I know eventually we will be done with this journey.

Timeline

The 2nd visa within 2 years is a K1 requirement, not CR1, so no waiver required in your case.  The K1 refusal means it's closed, but for peace of mind you could withdraw so you don't leave anything hanging.  It doesn't take much and the peace of mind may be worth it.

READ THE INSTRUCTIONS for the I-130!!     Slow down .. read them twice. :yes:  :lol:      The answer to your question is there .. or the lack of it ;)     (and as others noted - the answer is NO)
