Hello together,

 

I would like to ask if the beneficiary can withdraw the K1-Visa.

Well I had my interview last year and since then I have been on administrative processing .

 

However I broke up with my fiance and I am no longer together with him.

So I emailed the us-consulate to cancel the K1-Visa -Application.

I received the Information that the petitioner has to write a letter to the consulate to cancel the Visa.

 

I was thinking that the petitioner can only withdraw the I129 Petition.

Why the beneficiary can't withdraw the K1-Visa?

 

I dont have any contact to my ex and I would never contact him.

Is there any other way to withdraw or stop the process without involving the petitioner?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Didn't you just ask that earlier under another identity?

You still only have petition pending, you never got your k1 visa in hand. 

 

Only petitioner can do that. 

K1

29.11.2013 - NoA1

06.02.2014 - NoA2

01.04.2014 - Interview. 

AoS

03.2015 - AoS started.

09.2015 - Green Card received.  

RoC

24.07.2017 - NoA1.

01.08.2018 - RoC approved.

Thank you. Well I do not get this.  It is two different cases, the one is the Petition, the other one is the visa.

I applied for the Visa at the consulate and why I can't withdraw the visa when it is done by me

I dont think so. I find out that my fiance did cheat on me and I ended the relationship a month ago. Actually I dont care about the Status of the visa but I hate him so much.

I did it already. This is the response: In order to cancel your K1 Visa application our office is in need of a withdrawal letter from the petitioner.

I agree with @Dee elle.  Just allow it to expire.

It was really nasty. Thats the only reason why I want to cancel it.

No they don't have my passport. Well here is the matter: How it is going to expire when the Visa is on administration processing?

The reason is, is because the only reason you're even allowed to apply for the visa is because the petitioner petitioned the I-129 for you. 

If it wasn't for the petitioner doing the I-129, you wouldn't have any grounds to apply for the visa in the first place.

The visa is directly tied to the I-129, which the petitioner filled out.

They're saying if you're in AP and you get the visa, you just ignore it. If they ask for your passport back, you can just ignore it. If your visa gets rejected then no problem there.


If you want the entire case to be closed out, then the petitioner will have to do it.

Thank you so much. I just wasted my 4 years and a lot Money. But that's life and I am so happy that I find it out before marrying him.
