Error in my 10 year GC

Hi Everyone!

Does anyone have experience with similar situation?

Yesterday I received my 10 years GC with wrong Date of birth (USCIS error and it happens 2nd time!).

I’m going to fill out N 400 now (I’m eligible through marriage).

Can this error in GC affect my case?

Should I fill I 90 before applying for naturalization? The process time for I 90 is 7-15 months!

I’m frustrated because it’s not my fault and it can be cause a long delay of my case.

I appreciate  for any help offered!

You should get the GC fixed...there won't be a fee for it since it was USCIS's error.

As for the processing time, by the date your N400 interview rolls around, gives you plenty of time to receive the corrected GC.

(make a photocopy of the incorrect card, however, as you will need it to file the N400).

 

Can it affect your N400 case if you submit an incorrect GC as part of your evidence?  Hard to determine as that will largely depend on the IO adjudicating your N400 and if they want to be a stickler about the incorrect info on the GC, even though it was in their error, since your responsibility is to inform them of any mistakes on the card itself when you receive it.  Also, in the worst case scenario of the N400 being denied (for other reasons), you would then have to get it corrected anyhow.

Thank you for advice! Definitely, I’ll apply for replacement GC.

What documents should I submit in this case? Only those that proof correct information about my DOB such as Birth Certificate and Passport or bunch of documents such as tax return, bank statement, and utility bills?

Birth certificate is sufficient in proving date of birth....the other stuff you mentioned doesn't prove DOB.

With the N400, I would also include a short statement regarding the incorrect GC, mention that you *just* had it issued, and a copy of the filing for the i-90 showing you are also in the process of correcting it.

Yes, USCIS sent me the new GC right before my Naturalization interview))) 

I don’t remember exactly, I think it took 4 months

I am in similar situation. USCIS put wrong birth year on my PR card. I was approved on 2/26/19 and my lawyer told the IO to correct the date as well so it’s a DHS error. 

 

Do you know how long does it take with that I-90 process? Will I have to do the Biometrics again? What about another interview?

In my case it took 4 months, and there were neither biometrics nor interview.

No biometrics nor interview because it was a DHS error right? Does the wait depend on your FO?

Not sure if this is the norm but when my husband filed the I-90 to fix a GC error, he was called for biometrics.

I'm pretty sure the regional FO's may have something to do with because it took my husband over 1 YEAR to get his corrected GC back...(Our local office is Portland, OR btw). Recently on VJ I've heard that other folks filed an I-90 and got theirs back in 2 weeks....

Error with the "first name" field...my husband's first and middle name were listed under the "first name" field, the "middle name" field was blank...this resulted in his "first name" appearing as "JOHN MATTH--" (the name was cut off) and no middle initial. We checked in with USCIS at the local FO, they confirmed that the name was indeed entered incorrectly in the system. It was their error, we did not have to pay the fee. We did have to upload his translated birth certificate as evidence for how his name should actually be listed.

 

No idea why the processing took so long...maybe errors in names take longer to process? It's a total mystery.
