Hello,

I have a question for a friend on mine. He is Filipino was married in the Philippines to Filipina for long time. When he brought his wife to the USA, she left him two years later for another man. They got divorced in the USA but no annulment in the Philippines. Now, he wants to marry someone else here, does he need an annulment still or the US Divorce is enough?

Thanks!

If he wants to marry in the Philippines then he needs an annulment. If he wants to marry outside the Philippines then it's fine.

I have moved your post to the Philippines subforum.

Then it shouldn't be so problem at all because the USA recognizes the divorce.

The Divorce will be accepted for the visa process at USEM.

Did your friend  acquire USC?  If yes.  The divorce is accepted after it has been through the RTC for recognition, then filed with PSA.

If both were still Filipino at the time of the divorce then it is as Cyberfx stated .. annulment is needed IF they want to marry IN the Philippines.

There is a depends in there;   As long as one party of the divorce is a foreigner the  Supreme Court in the Philippines recently ruled that even if the Filipino initiated the divorce that is acceptable.

If either one were naturalized USC then the divorce would be acceptable
