And the medical + biometrics...I'm pretty sure something major will stick out to the PP when somebody else shows up.

 

Either there was some mistake with the data entry and it matched the wrong person, or she was petitioned by somebody else in the past and it was not withdrawn.

Or she's not being honest about having a us fiance.

I wonder if it was just the CO asking a question to see a reaction.  As others have said, the complexity of identity theft to file for a K1 is pretty large, if it is actually identity theft, I would look at the OP's daughter's friends as someone would need to get the necessary documents to the USC for a K1 petition.

we really dont have divorce in the philippines and you are right annulments takes forever and are expensive.

A K1 Visa is not put in there for the sake of it.  Why would it be there and she otherwise lie to the consular officer?  Unless you can convince me otherwise, there is more to the story.  K1s like immigrant visas (or any visa for that matter) is not given out or denied at willy nilly will.  You can't tell me that someone deliberately went to the US consulate and put in a K1 Visa in this person's passport.

Well it's really rare.

It is a pending K1 visa which means that someone went to the us consulate already.

If that's the case, then you need  more documents like police certificate, birth certificate in original.

Maybe you should talk to her if she is telling the truth.

theres lies on both sides of that genetic barrier lololololol

 

i would bet dollars to donuts that at least at some point in time....current, recent or far past.... there was a plan for her to move to the US with some dude.

I think there are three scenarios:

  • 1) Mistaken identity
  • 2) Stolen identity
  • 3) She has / had a fiance and isn't being truthful.  Which, if it is the scenario, her immigration path is now even more complicated because she lied to a CO.

Figure out which of those are correct, come back and let the board know.  Because if it's 1 or 2, there are lessons learned.  And if it's 3, there's an even bigger lesson learned.
