my daughter had an interview in the US embassy few weeks ago, everything was fine until the interviewer saw something. He said that she has a pending K1 Visa and asked if she had a foreign fiancee. she told them she didnt have any fiancee. she is just coming to the US to visit me.

But they denied her because of it. i think they just make a mistake or her identity is stolen. 

can you advise us what we will do to straighten the facts?

So what did she say when he mentioned the K visa? Did she tell him she didn’t have any pending visa? Would be very unusual for them to get this confused as it needs to match names, birthdate etc.

what would be the goal of stealing her identity for a fiancé visa if she is not the usc? But yes maybe you should check this angle out.

what country is she from by the way and what are her ties there?

yes she did tell the interviewer that she doesnt have any pending visa case. but he look upon her passport number. 

sometimes you just dont understand people. they steal identity because they make a mess on their own identity. and they cant use it to get a visa.

If identity theft is the actual issue, then probably need not be concerned about a visa at this point but get that part of things straightened out... as was mentioned though, seems a lot of work to do a K-1 visa honestly; but again if that's the case it needs to be resolved there in the home country with the identity theft first, the rest would almost correct itself (canceled passports, ect).

02/03/2017 - Married

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

im leaning towards there is more to this story, too.

 

the amount of original documentation you need to have is astounding, and assuming it is all in your (or your daughters) possession, unlikely for an identity thief to have. As well as all the background information regarding names, addresses, employment, family members, etc. The passport pages, photos, etc etc etc

 

i wont say impossible, but.... improbable.

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

i wont say impossible, but.... improbable.

she had all the documents she needed. she had a good work and been working there for almost 5 years. she has some properties. in the first part of the interview it all went good. but then to interviewer saw that K1 visa pending case. she had asked her 3 times about having a foreign boyfriend. then looks at her passport. and ask her again. i guess i have to call the US embassy in the Philippines to know more about it.

i too lean towards "there is more ice cream than what it is presented"

Hmm, I'm not really sure how you can clear this up if she is telling the truth. Identity theft really sucks. Being from the Philippines I can see a reason someone would do this though, but wow it would be a monumental task. In the Philippines if  your divorced it's really hard to get a k-1 approved (annulments are expensive and take forever!) Hence yes there is a possibility someone tried to use her identity to get a visa. (but again no easy task with having to get all the necessary forms and documents, pictures....etc.) So very unlikely.

Well then as I said befor you need to look into that. Presumably report it to the police as well as the passport agency, as there must be a fake passport out there if the passport number is the same.

With respect that objectively means nothing. Seen on here before: people marry usc, get green card, divorce usc, wait the required amount of time then marry and sponsor original boyfriend/girlfriend for green card.

Is identity theft possible here? Sure..but they would be quite foolish to try it IMO. As others noted, the amount of money and work that goes into the K-1 process to get it to that stage is quite significant. They would likely be able to do a lot worse than to attempt apply for a K-1 visa. It's a huge, expensive issue, and would mean a USC is in on it (committing perjury in the process) + a Fiipino being in on it with the required false/stolen documentation. And the medical + biometrics...I'm pretty sure something major will stick out to the PP when somebody else shows up.

 

Either there was some mistake with the data entry and it matched the wrong person, or she was petitioned by somebody else in the past and it was not withdrawn.
