How to get info on a non-received NOA1

Hello all,

just wanted to pass this info on to you.

I filed my I-130 paperwork last month on the 4th, to date I have not received an NOA1. I decided to call and this is what took place.

I called USCIC and told them it had been over 4 weeks and no NOA1, they then transfered me to a man who took my social nnumber, last name and first. he then verified the date in which they received my paperwork, then also gave me the date of approval. He said I should have received my NOA1 last month on or no later than the 17th! I explained to him I had not received it, then requested another copy. He then told me that he could not issue another copy until the original was sent back by the postal service.... hmmm what if there was another breakdown and it made it here but the postal system failed etc. He said I would have to file another batch of papers... Ok... Now what. I asked for another solution, that that would not work for me, he paused for a moment and said ok, here's what I can do. He gave me the receipt number of the NOA1.

I then went to the USCIC site and entered the receipt number in and registered for my account there for tracing purposes. My paperwork immediateely showed up. I then typed a cover letter explaining the details of my unfortunate situation and included it with my "I-129F" paperwork and sent it off. The man said that should work, because they will cross reference the info anyway.

So there ya have it, my problem, solution, and forward action.

I am in the same situation, I have sent in my I-130 on March 11 and they got it on March 14, its almost going to be a month and still no NOA, also my check has not cleared yet. So in this situation, should i call them even thou my check has not cleared? or should i wait until my check clears and then call them. Kinda getting worried now that after reading the forums, alot of ppl got there NOA1 within 2 weeks.

That is great! But not for our situation.

We had the same problem with not receiving the NOA1, but unlike you they cannot find us in the system. At the infopass appointment my husband was told this was due to our common last name. Not sure if that is true or if they lost our stuff. Regardless, they told my husband we would not lose our place in line as we had a copy of the cashed money order (unable to read receipt number on the back). So my husband has sent everything off with a letter stating our situation. For anyone who has our problem I would suggest getting that infopass appointment asap.

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

Did you check with the USPS to find out if they received your case? It's very odd that they haven't cashed your check so you should definitely try to find out if they at least received it.

I also did not get my NOA1 until 2½ months later, but we were approved a week after I received it. The good thing is we now know for SURE that you don't have to have a copy of the NOA2 to file an I-129F for the K-3 visa as long as you have the receipt # for the I-130 and let them know.

yeah i checked there website, and stated that they recieved the file on March 14, 2007. I think i might go ahead just give them a call and see what is going on.

If they don't show you in their system you should make an infopass appointment to find out what is going on. It's been too long already not knowing what happened to your petition.

I had a similar situation, but luckily I already had the receipt number (since I had initially sent a photocopied I 129f with a photocopied signature, it got returned to me complete with the receipt number.)

So I was able to go online and find the status, and it gave the date my NOA1 was supposedly issued, even though I never received it.

I called and asked about it, and they said since I already have the info and everything, there is no point in sending me another paper NOA1 since it is essentially a meaningless piece of paper that wouldn't tell me anything I didn't already know. Which seems like a legitimate point, actually.

They said presumably it got lost in the mail - it sounds like that happens fairly often, there must be something wrong in their system of mailing the NOA1's.

1/24/07 - I-129F mailed to Nebraska Service Center

2/4/07 - I-129F returned to me, needs original signature

2/5/07 - I-129F re-submitted to California Service Center

2/9/07 - I-129F received per CSC; I never received hard copy NOA1

2/14/07 - Touch

3/11/07 - Still awaiting snail mail NOA1

4/18/07 - Touch

5/4/07 - Touch - "Marked for approval" per RFE trick phone call 5/18

There has been a HUGE problem in the past few months of USCIS not sending NOA1 for I-130 to people. I am surprised that they don't do anything about fixing this problem since many people probably call them with this problem. But then again, I expect this type of stuff from a government bureaucracy.

i don't think it's fair of them to ask for another I-130 submission, considering the amount of time and effort and money spent on accomplishing the first I-130 packet, seriously

and suggest another $190 be sent their way... wth?

seems like me and you are in the same boat. Has your checked cleared yet? if you sent a check. I called them yesteday and they said that if your check has not been cleared most likely your file has been rejected and would have to wait until they sent the file back to see what the problem was. They didnt even have me in there system and they recieved my file on April 14, 2007. I also send it to VSC.

I am not too glad to hear that. I sent a check and it has not cleared. But, they didn't tell me anything about the possibility of the file being rejected. They just said that I should be patient as it can take as much as 45 days for them to receipt the file. I'll keep my fingers crossed and continue to keep tabs on that check.
