Texas does not allow first cousin marriages.. 

 

New Mexico or Colorado would be the nearest states allowing it.. 

 

EDIT:

and upon more google searches, in TEXAS, you can NOT be caught having sexual releations or cohabitations are not only allowed, but it is actually a felony. 

 

Correct me if I'm wrong.

Thank you for your reply. I am aware that Texas does not allow cousin marriages. I was just wondering if there might be a denial coming up, or if there will be complications with my application. Should I be worried that I will receive a denial?

From older threads I found, yes. Your petition will be denied due to Texas’s state law.

I’m not attorney and I’ve never been in your situation. I can only assume your fiancé(e) will have to move states to where cousins are allowed to marry or they move to your country. I would ask someone with better equipped knowledge for sure.

Currently no, I don’t have the intention to move to another state, but from where I live, New Mexico is only 30 minutes away. Last time I checked NM allows cousin marriage. The question is, must I be a resident of NM for me to get married? Will Texas recognize my marriage if I did it in NM?

Texas would recognize the marriage, although the laws noted above about relations and cohabitation may or may not be enforceable still.

 

As for immigration, you won't qualify to petition her as you are not free to marry her according to local law. You would need to change residence to somewhere where it is permitted.

it IS still a crime to have a sexual relationship or a cohabitation with your first cousin.. 

 

SO, if you are just 30 minutes from NM, it might be the best to live there..

So from what I am gathering I am more than likely to receive a denial. Because not only do I reside in Texas but I have stated that when my fiancée comes I will still be residing in Texas. So I have a bigger chance to receive a NOID rather than an RFE?

I appreciate your input. Do you think I should withdraw my petition, since a NOID is more than likely and go marry my fiancée overseas and apply for the marriage visa?
