Hello eveyone!

I have been register for a couple of weeks now, but just found the introduction page.

My name is Lisa and I meet my fiancé almost 22 years ago. We dated for 1-1/2 years and then went our separate ways.

We reconected last Fall and pickup where we left off. We couldn't be happier.

I want to say a big thank you to my friend Jeremy for sending me the link to this place :)

After viewing the different forum I have a few question:

Is it possible to get married in the US without applying for K-1 ?

What papers do I need to get started with?

Welcome to VJ. I can't answer your question about getting married here but if you came to the U.S. on a visitor's visa with the intent of getting married that could be considered fraud and could cause you so grief later. The K-1 is a fairly simple process and you would have a ton of folks here that could help you with any questions. Good luck :thumbs:

As long as you both are free to marry ,K-1 visa is the best/legal way to get here and marry. Do the right way not the easy way so to speak.

As to your question whether it's possible to get married in the US wihout a K1, the answer is YES. You do not need a K1 in order to get married in the US.

However, applying for a change in immigration status would be another question altogether.

Since you are from Canada, you can easily come into the US without needing a visa. However, it is stll possible for you to be denied entry at the border if they determine that you are entering with intent to immigrate. That's why, if that is your real intent: to marry and stay, then it would be better to go through the K1 visa process.

Our wedding is set for August 30, 2008, and I have some concerns when I should apply for the K-1. I don't want to apply to early or to late.

With a K-1 you can apply now. If you finish the process early and enter the US more than 90 days ahead of your wedding, you can get a legal marriage at a courthouse and have your planned wedding later. But in general its not a good idea to set a date until you have a visa in your hands. Although most people will make it through in 6-9 months, some people get held up in AR/AP for few months to a year or more. I would suggest that you file now.

Hey Lisa! Welcome aboard!

Don't worry about filing too early. There are stalling tactics you can use if it looks like it will come up too quick. One of them being that Stéphane would have 4 months after receiving the visa to use it, and then 3 months after arriving here to actually marry. It's uncertain to me, however, if once he has the visa in his passport, that he would be able to enter the US without "activating" the K1, which remember is a one time entry visa. So, he'd be "stuck" in Michigan with you until he gets his green card or Advance Parole for Travel if you file for it once you get married.

So, your timeline would most likely be this:

File the K1 petition, and say the California Service Center receives it June 1

approx. 90 days later CSC approves it: September 1

Montreal Consulate receives and sends the Packet 3 to Stéphane: October 1

Stéphane has his interview scheduled within about 3-4 months: December 1 - January 1

Receives the K1 visa in about a week after interview: December 7 - January 7

Up to four months to use the visa: April 7 - May 7

90 days to marry once Stéphane enters: July 7 - August 7

So, your best bet would be to either try to delay/reschedule the Montreal interview. Or, have a legal ceremony at the courthouse first once he arrives, and the wedding on August 30, 2008 as planned, if you don't have an objection to separating the legal marriage and the wedding in front of your friends, family, God, etc.
