hello all,

I was filling out ds-156 form (for my wife, India, mumbai embassy) and not sure what to put on question 36. it goes like this..

"Has anyone filed an immigrant visa petition on your behalf?" YES or NO

are they refering to I-130 that I filed for my wife earlier..??

not sure if "immigrant visa petition" has a different meaning..

should I put yes or no..??

thanks for any suggestions/tips. :)

07/31/2011 -- US Citizen wife applied for her parents I-130

12/12/2011 -- Got NOA1 ONLY for mom's file

12/22/2006 -- got married in india

01/17/2007 -- I-130 packet sent to NSC

01/27/2007 -- moved to CSC

01/29/2007 -- NOA1 received

04/19/2007 -- NOA2 received

K3 -- I129F

2/12/2007 -- packet sent

2/22/2007 -- NOA 1

4/25/2007 -- notice received in mail

5/10/2007 -- NVC recieved case (finally, after 3 weeks)

5/14/2007 -- NVC sent case to Mumbai embassy

5/21/2007 -- Embassy received case

5/31/2007 -- wife sent in packet 3

6/15/2007 -- wife received packet 4

8/23/2007 -- INTERVIEW DATE wohooooo + got K3 visa on 23rd :)

9/03/2007 -- sweetheart is here in US

AOS - EAD

9/17/2007 -- AOS/EAD package sent to chicago lock box

9/26/2007 -- NOA 1s for 485 & EAD

10/1/2007 -- biometrics appt letter received

10/13/2007 -- fingerprinting....speed it up guys..

11/28/2007 -- card production ordered - EAD

03/04/2008 -- final interview for greeen card :)

Yes, they are referring to an I-130. I answered yes and under "Who" I wrote "I-130 for CR1 pending, Spouse"

Yes, they are referring to an I-130. I answered yes and under "Who" I wrote "I-130 for CR1 pending, Spouse"

thanks for the reply..helps a lot...actually, I still have 1 more question now..not sure if I am being too picky...

in question 21,,they ask present occupation...my wife is done with school but she is not working anywhere as well.she is just taking some computer classes. I guess, it would be okay to put down student.??

what do you think?

Hi "pushbrk"... just want to clarify something about DS-156.... isnt it the form is to be filled-up by the spouse being petitioned? ,, so question #36 should be answered by NO? just want to clarify :help: , i am actually currently filling-up DS-156 form... thanks for the answers... :thumbs:

3/05/10 - mailed I-751 packet

3/12/10 - arrived at CSC

3/16/10 - online status, NOA mailed but no mail received

3/18/10 - Check cashed

4/15/10 - biometric appointment (notice recv'd in mail - 4/01/10)

4/16/10 - touched

4/18/10 - I-485 & EAD touched????

5/03/10 - Card production ordered

5/11/10 - letter of Approval received in the mail

5/26/10 - email received "letter of Approval" sent in the mail... not yet received till now 6/8/10

7/07/10 - called USCIS why green card has not received yet

7/09/10 - email from USCIS stating that they already sent the GC on May 25th and undeliverable,

adviced to apply for I-90 as it might have been lost in mail

7/25/10 - mailed application for I-90 (replacement of lost or stolen card)

9/16/10 - biometric appointment

9/20/10 - touched

9/21/10 - touched

The DS-156 is a visa application. It is filled out by a foreigner. If that foreigner is applying for a K3 visa, then their spouse has filed an I-130 Immigrant visa petition in their behalf. For a K1 applicant, the answer would be no. For perhaps all other cases where the DS-156 would be used, the answer would be no. The OP is a K3 applicant, as was my wife.

Somebody posted a link to an example filled out DS-156. The example shows the NO box checked. There wouldn't be a YES box if it were not applicable in some circumstance. It is applicable for K3 visa applicants.
