Hello!

 

I have read and understood so much about being able or not able to travel while your K1 visa is pending. Unfortunately there is not a lot about leaving the US while a K1 is pending. I just filed my I 129F form and I would like to know if I (the petioner...American fiancé) can go visit my fiancé in the other country? So I would be leaving the US to visit my fiancé in Brazil while I just received the NOA1. Is it ok to go visit another country while all of this is going on?

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

They can come here on an existing visitor visa.

 

As long as the US Citizen's "visit" does not result in a sponsorship issue that cannot be overcome, then there are no "travel restrictions" on a US Citizen related to being part of an immigration process for a fiancee.

Facts are cheap...knowing how to use them is precious...

LOL I think we all did that (while a petition is pending) or at least most of us did.  Not only is it OK, but every minute of time you guys physically spend together helps build the case for valid relationship at the interview (it's good for any couple anyway).  Take pics, keep plane/hotel receipts to toss into the "valid relationship proof pile", enjoy your trip!

I agree with all of the above. I visited Joan 4 times in that first year (twice while I-129F was pending). We got lucky and I was in the Philippines for Joan's interview. The consulate was surprised (in a good way) when we answered "4 times" to the question "how many times has your fiance visited!" He actually looked up from his pile of papers for a second! :)

 

One note on the comment above about the beneficiary being able to come here during the process: that may be true technically, but in reality it depends on the country and whether the US Embassy there would grant a visitor or some other type of visa. There was a slim to no chance of Joan getting a visitor/tourist visa from the Philippines---hence my four trips there.
