I-129F Beneficiary's Brother is out of status - Will that affect us?

Hello,

I just mailed in my I-129F petition today, thanks very much to the great information on this forum and website.

My fiancee has two siblings; both are in the Unites States. Her older sister is a US Citizen (naturalized through some investment visa some years ago), and her younger brother is currently out of status in the US. He was here on a student visa, and I believe he is currently overstaying his visa.

Assuming that my fiancee's brother doesn't correct his status, can that affect our I-129F petition? Also, can it affect her interview at the Delhi Consulate when it gets to that phase?

Any advice is appreciated.

I read of one post about a K1 interview in the Philippines where the CO checked the status of the K1's brother who was in the US with a work visa. I don't know if that's just something that's peculiar to the CO doing the interview or it's something that's done on a per embassy basis. I am not saying that this could happen to your fiancee but I am interested to find out if there are more of such occurences.

I'm hoping that someone who has a similar situation will share their experience here.

08/21/08: TSC cashed check

09/02/08: Received NOA...........Priority date: 08/20/08

09/18/08: Biometrics completed - Charlotte DO

10/24/08: Received Interview Letter

12/08/08: Interview @ 1:00pm. APPROVED!

01/05/09: Oath Ceremony 10:00AM. Now officially a USC!!!

I have a followup question. When my fiancee needs to fill out the electronic form DS-156, for question #37:

Are Any of The Following Persons in The U.S. or Do They Have U.S. Legal Permanent Residence or U.S. Citizenship?

Mark YES or NO and indicate that person'sstatus in the U.S. (i.e., legal permanent resident, U.S. citizen, visiting, studying, working, etc.)

[My fiancee has a brother and a sister, sister is U.S. citizen, brother is out of status.]

There isn't even enough room on the electronic ds-156 to put down the sister's status, so how do I indicate the brothers status?
