I have a concern if someone would be kind enough to help me. I think I am worried about nothing, but I like to make sure of everything. I am going to be filling out the I-129f to get my fiance here to the US from the Philippines. I have a great background as in my work history, lived in the same area in Texas, I have never been married, have no kids, I have a great job now, and everything should look great to them except this one thing that I am unsure of how they will view it. I am 35 years old. My concern is my criminal background for where I have to check yes to 3 or more drug or alcohol charges. I have had no other legal problems.  I have 5 that were all misdemeanors. I had 2 different possession charges way back in 2002, a PI that got dismissed in 2005 or close to that year, a DWI 2 years ago, and a PI over 6 months ago. She has no problems with her and she is aware of everything about me. Is this something I need to worry about? This has been driving me crazy and it may be for nothing. Any advice would be greatly appreciated. Thanks in advance!

PI as in possession with intent to sell/distribute, you mean?  Wasn't sure if you meant PI as a sort of short form for saying those two charges happened in the Philippines...just wanted to clarify.

 

What were the final dispositions in the DWI and most recent PI charge?

CLW, you sure have been busy inside the system. However you as the USC is not going to be under the "moral" microscope, but your Filipino fiance will be. As long as she has a clear police/court record, and you meet the other practical requirements, you all should be fine.  

 

Likely the PI is for "public intoxication".

All those misdemeanors might sounds unrelated to a K-1, but best if you ask an attorney.

10/21/2018                Card was mailed to me, and yes it said so on a Sunday night, while Vj-ing

10/22/2018                Card was picked up by the USPS

10/24/2018                EAD in hand. F%^&& finally

12/28/2018                Interview has been scheduled. Waiting for notification with date by snail mail

No sorry... PI as in public intoxication. 

I served probation and everything is taken care of for the DWI. The public intoxication was just a class c misdemeanor and fine has been paid. 

So no drug involvement except for 2 years after high school.

ok then you are better off in regards to a K1----I thought you meant drug charges.

I too had a criminal background ranging from 1985 to 2009 (2 felonies, some misdemeanors and 1 traffic) that i WAS CONVICTED.  I checked off that I had been arrested.  I was RFE'd and what they asked me was for all my CONVICTIONS and FINAL DISPOSITIONS and they wanted police reports for each (The retention on police reports in California is 10 years).  I went down to the courts and requested all my docket sheets for each case, had them certified (didnt pay for certification because it was my case).  USCIS accepted the documents, case was approved

Wow! Thank you!!! That’s what I was looking for was someone that has been through the same things as me! I’m glad it worked out and it gives me lots of hope that mine will too! You have no idea how much I appreciate your response!

Dont stress, just go to the courts and get your papers CERTIFIED and stamped by the clerk.  Submit them with your petition or wait for the RFE.  As long as you are truthful all will be just fine.
