Hi, my name's Rie. I entered U.S. as a visitor fr Japan. My American BF wanted to marry me so we got married in Las Vegas last month ,he doesn't want me to go back to Japan and would like me to stay and live with him, we rented a new apartment with me as co consignee  included my name in every billing for water, electric, gas .

I'm worried because my visitor's visa will expire on July 17,2018.

What shall we do? Is there's a way I can be able to stay here with my husband? Can somebody in here help us or give us details or legal information on how to do it.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Read and study all the forms. It's a DIY process in most cases. Once you file, you are put into a period of authorized stay. You cannot work until you have an EAD or green card.

If you leave the US without AP or a green card, your I-485 will be abandoned and you will need an immigrant visa to return.

I couldn’t get up and abandon. I’d suggest a CR-1 but I like to follow legal procedure. You may feel adjusting is shorter and correct for what you feel is correct. I just couldn’t feel right adjusting in this current political climate. My fiancé is from Las Vegas too. Good luck adjusting nevertheless.

My visa is under the VWP ESTA 

since I'm japanese. What initial legal steps should my husband do

to have me here even if my 30 days visa expires? Pls give me  advise  on what to do.  Thanks and God bless you

Hi,I'm Rie and japanese citizen  I entered U.S.with visa waiver program last April  , got married to my American boyfriend  in May here in the states. Can my husband file i-130 even if I'm here inside the U.S.?  Would it be necessary for me to leave the country or can i just wait here .

my visa will expire in July 17.

I'm also deciding to go back to Japan and come back here again after sometime .

He can file it with you there, but it will take about a year for the whole process to finish, so you will have to go back to Japan before it's finished. You can visit him though (and he can visit you). But you can't stay in the US to wait for the whole thing.

2018/03/02 - NOA2 (Approved!)

2018/03/19 - "We sent your petition to the Department of State"

2018/03/23 - NVC received petition

2018/05/17 - Case# received and fees paid

2018/05/21 - Case# changed -- can't log in with the new one so "we've sent in a 'ticket' to get it fixed"

2018/05/22 - Scan date. Ticket worked, submitted all our paperwork until the wee hours of the morning. 

2018/06/11 - CC!!! "Documentarily Qualified"

2018/06/25 - Got interview date for July 11; but we must reschedule for August. 

2018/06/26 - Medical

2018/06/28 - New interview date received (for August 13th)

2018/08/13 - Interview in Frankfurt!!! They asked for certified translations.

2018/08/28 - Sent in translations

2018/09/06 - CEAC status changed to "ISSUED!!!"

2018/09/13 - Passport received in the mail! Everything is beautiful.

You can either file the I-130 and go home for consular processing or you can stay and adjust status (AOS) by filing the I-130 and I-485.  With AOS, you can file for EAD/AP which will allow you to work and travel internationally while waiting for your green card.  EAD/AP takes about 5-6 months.  While waiting for AOS, you will be legal in the US even after your I-94 expires.

Isn't that only legitimate if it wasn't your intent to marry someone when you arrived in the US?

Thanks for the advise. Can you please enumerate the documents needed for the AOS. We already have the i130 & I485. Thanks and God bless you,.
