Hi all,

 

I know this is one of the most asked questions on VJ, but I am writing this after many self-emotional renewals of being patient about the AOS process and now i don't have the ability to renew my patience anymore. I need to take some action whilst maintaining my sanity. I would appreciate any help I can get in this regard

 

I came to US in Aug-17 on a family holiday for few weeks with enough finances to cover my expenses for the trip. But life had planned something else for me here, i found the love of my life in October-17 and we got married in January-18. We initiated our AOS process straight away with our priority date being JAN 30-2018. I binged on forums like VJ to do the AOS application as affording an attorney was not an option for me because I was already stretching my pockets to keep the basics of life going on.

 

Our AOS application timeline went super fast, we did not get any RFIE's. 01March-2018 did biometrics, 07April-18 got letter for interview and 07May-2018 we had our interview. We were expecting to receive EAD prior to the interview, get our own place and have joint lease, bills etc, but that did not happen, which was the reason we never had the opportunity to have a lot of joint documentation for the interview as my wife is a full-time student and we have been living at her parents home ever since we got married, we mentioned this to the IO during our interview and she said she is used to seeing cases with not a lot of joint documentation. Given that I am adjusting from a B2 visa to a GC I have not had any prior work authorisations or EAD either.

 

It has been 6 weeks since our interview and we have not received any updates beside the fact our status shows "Your Interview was completed and case must be reviewed". I am literally running out of finances now, been in US now for the best part of a year without a job surviving on savings, but that can't go on anymore I need EAD or GC desperately to move out of financial meltdown. How can i put my situation across to USCIS in the best possible manner which may have the highest chances of getting an outcome from them

yeah those are the options I am faced with

1. Senator/ Congressperson

2. Ombudsman

3. Service Request 

4. Info Pass

 

Not sure which one is applicable in my case  and where to start, as the standard USCIS response after the interview is that we may take unto 120days to adjudicate your case and it has been 40 days since our interview so far

We spoke the customer service and they basically repeat the same status which is available online. According to my understanding you get interviewed only after background checks and application review is complete, what more is there to it in terms of checks to had ?

Do you not have EAD/AP?

No i don't. After my biometrics appointment USCIS called one of my relatives to verify our marriage and then we got scheduled for interview. I never got the EAD/AP Combo card.

Can you expand on this? Never heard of this before. Who did they call, what did they ask, and why? Strange. 

 

As to your question it's probably too soon to contact congress representatives or ombudsman. Best option is to call USCIS and ask to speak to tier 2 representative, or make an infopass appointment, or submit a service request.

Perhaps you and your wife should have a serious discussion regarding your lifestyle and living situation with your in-laws. Maybe she will have to quit school temporarily and get a job to help with expenses. There are many people waiting and most much longer than you. Patience is a necessity. Good luck!

I included 3 letters from close family members for affidavit of support to serve as a proof of our marriage being bonafide, and they called 1 of them to verify about me the beneficiary. Questions were basic along the lines of; How long have they known me for and how I am related to them etc. 3 weeks after this call we got our interview notice. 

 

I want to know which one of the 3 methods (i.e A. Call USCIS and ask to speak to tier 2 representative B. Make an infopass appointment C. Submit a service request ) will be the most suitable to be able to explain and better put across the matter of the financial hardship that I am going through

Do you mean I shall let things take their course, as it may not yield any outcome ?

I would focus on the EAD, something wrong that you have not had it yet, a job offer and getting it expedited may be a good bet.

Can I still get an EAD after the Interview as per my understanding after the interview you only get GC :wacko:
