Big difference between living apart and spending little time together because you can not reside in the same country with your spouse before getting the CR-1 versus living apart and spending little time together after getting the CR-1 and getting a green card.

True, although they typically don't have the ability to live together, or at least not do so easily. Different situation, and I think an IO would take the ability to live together into consideration.

All good points. However people successfully ROC that live apart. It can be because of school, work or family situations. You cant really assume because someone cares about work or school or an ill family member and are spending time 'there' that they dont have a real marriage because if they did (have a real marriage) the spouse comes first so they wouldnt be doing whatever it is they are doing.

 

The main issue here is being in the country for 94 days out of 2 years. She has to convince them she didnt abandon her residency. If she has the 'traditional' bonafide evidence items the question of is it bonafide shouldnt come up.

Seems the marriage ended shortly after the GC, it is the combination that makes things more challenging.

 

With School etc then you would expect people to make an effort during holidays etc, even weekends.

So you had a temporary GC based on marriage but really didn't have much of a marriage and have only been in the US for 94 days. Honestly I'd be surprised if immigration even let you through customs.
