Guys i would really appreciate all your suggestions!! i am a canadian citizen and got married in january 2007 to an american citizen, we applied for I130 back in feb'07 and received a notice of action on feb 21st stating that our application was pending....since then we haave heard nothing from the uscis and today i found out that my lawyer did not file for the k3 either!! any idea regarding what i should do next.........thanks

Had you told your attorney that you wanted them to submit an I-129f? He'd prepared an I-129f and associated documentation for you and everything was signed and ready for him to send?

The I-130 is 3 months into the queue now, I might be tempted to forget the I-129f. But you haven't mentioned anything about what your plans, circumstances, hopes, and dreams are so there's really no way of speculating what you might want to do.

thanks for replying yodrak, my lawyer very well knew that he had to apply for the k3 so i could possibly get there sooner!! but he put the blame on one of the girls in his office...anyways i obviously want to be with my wife asap, its really taking a toll on us...we want to start our lives together and have a family soon!!

As for your question of what to do next, I would fire the attorney. You don't need him. Then, forget the I-129F. It's really too late to expect it to do you any good and filing it COULD end up delaying your reunion. Then become very familiar with and use the following shortcuts.

The K3 would not do much for you now. I actually had the same thing happened to me. The lawyer that I hired didn't tell me that I need to file I129F for the K3 process. I actually realized the mistake after I came to this forum. Unfortunately it was about 7 weeks after I filed I130. Now my I130 is approved and my I129F is still stuck in the process because I filed too late. Many of the lawyers are good for nothing. They just worry about people paying them money nd they don't do anything unless you force them to do something. I actually gained much more information about the process from this website than from my lawyer who I paid $600. This site is much more valuable than the service of any lawyer.

Jan. 15, 2007 - Got married in India

Feb. 02, 2007 - Sent Form I-130 via Certified mail

Feb. 05, 2007 - NSC Receives Form I-130

Feb 07, 2007 - NOA-1

Mar. 15, 2007 - Touched

April. 11, 2007 - Touched

April 17, 2007- Approved!!

May 01, 2007- Touched

NVC Processing of I-130

April 27, 2007- Received by NVC

May 14, 2007- IV Bill and AOS fee bill Generated

May 22, 2007- Sent AOS fee bill

May 27, 2007- Received AOS fee bill in mail

June 11, 2007- Received I-864 package in mail

June 14, 2007- Still no IV bill. Called NVC so that they can resend it.

June 18, 2007- Sent completed I-864 package

June 22, 2007- Still no IV bill

June 25, 2007- Finally Received and Paid the IV bill!!

August 05, 2007- Sent DS-230

August 21, 2007- Case Completed at NVC

August 27, 2007- Case Forwarded to Embassy

October 15, 2007- Interview!! Visa approved!!

October 18, 2007- Visa in hand

October 27, 2007- US arrival!!

Do you think filing the I-129F now, 3 months after filing the I-130 will gain him any time? If so, why? I'm all ears.

In my opinion, you should just go with the I-130 petition. It looks like your I-130 should be approved very soon. The I129F saves you about 3 months but only if it is filed within couple weeks after filing I130. I filed my I129f seven weeks after filing I130 and I don't think that it is going to do any good for me. The IR-1/CR-1 visa would be issued and you will not have to worry about adjusting status with that visa like the K3.

I am sorry but i don't know the termanology, do i need a lawyer to file for the ir1/cr1, is it a visa?? how does it work?? this lawyer actually asked me to come to new york, as a canadian citizen i can go to the u.s as a tourist and then a[[ly for a change of status..i am really confused because i paid this guy a lot of money..

Hello, I have been reading over what has been written and will just tell you what we are planning on doing. I am the Canadian and my husband is the US citizen. We filed our I-130 on March 1st. As far as I can tell from going on to the time lines etc. if you haven't been aproved in 3-4 months, it looks like you are in for a long wait. There is another Candian on this site and their 1-129F was processed and the I-130 is still in limbo. She said they were very happy they filed the I-129F or they wouldn't be together now.

If we don't have anything by July we are going to start the process for the 129-F. Worst case is that the I-130 gets approved and we are out the $ for the I-129F application. Again, just my opinion. But I have read others opinions where they felt filing the 1-129F actually sped up the process. So again, it is very individual. For myself, the hardest part is that we were very naive when we started the process purely because I am Candian. We just thought it would be a lot easier.

Happy Thoughts for you, as I totally understand the stress you are feeling.

07/10/07 NVC assigned case #.

10/25/07 NVC Case Complete!!!!

01/22/08 Original Monreal interview- requested to reschedule, told 3-4 month wait.

04/17/08 Interview in Montreal

04/21/08 Received VISA package

06/24/08 Crossed border

07/26/08 Received conditional greencard

07/28/08 Received SSN in mail (went down and applied in person 07/14/08)

08/11/08 Infopass appointment to request 10yr greencard instead of conditional. Mailed out 1-90 with support.

09/25/08 Received case # for I-90

02/17/09 Received 10yr greencard!!! WOOHOO
