Hi everyone,

Hopefully by this time next week i'll have my visa in hand (interview is thursday)...

A quick question, once i've crossed the border and we are legally married, which form do i need to fill out to begin working?

Also, does anyone how long this takes to approve?

I beleive their is a temporary permit or something. I'm hoping i don't have to wait until the green card arrives.

18 August 2006 Received a request to provide more information we've met in the last 2 years

19 August 2006 Submit additional requested information

04 October 2006 I-129F approved at Vermont

07 November Received Packet 3 From Montreal For K1 Visa

08 November Submit form DS-230

21 November 2006 Submit Checklist

12 January 2007 We are put on wait list for interview

08 March 07 Contact Montreal Consulate and are told to wait for up to 4 months

April-May Phone calls and e-mails to Montreal Consulate are unanswered. Still Waiting

If you get the 90 day stamp upon arrival at the POE then a K-1 can work the first 90 days in country... After that then you can file an I-765

It's all about getting that EA stamp.

As well, there is a thread called, "things you thought of before you crossed the border" - check that one out too. It's a good reminder of all sorts of paperwork that should be gathered before making the big move.

As for the AOS portion of your journey - you can only file AOS after you are married, but most of the stuff you collected for the K-1 petition, should help you fill out all the forms etc. for this next step.

Feb 23 - Sent USCIS a message asking for a processing update

May 6 - Received an email response saying things were progressing normally but that waiting times might be longer

Feb 25, 26 & 28 - got emails saying that the cases had been transferred to another office, then to my local office, and then just transferred and are being processed

Mar 17 - got email, attached to one case number only, saying that my A number was changed relating to the I-130 filing

The card you are refering to is the EAD card which usually comes a few weeks to a month after applying for AOS after you're married. That will allow you to work until you get your official Green Card. You will have to renew it I believe after a year if you haven't gotten your interview yet, but most cases you'll get the green card before hand.

And some suggest you can get a temp EAD stamp at customs too, but I'm not familiar with that...

I wish it only took a few weeks to a month to get an EAD. It takes a LOT longer now to get an EAD (around 90 days I believe is the average). Many AOS & EAD applicants got their greencard before their EAD was even approved! :P

The stamp that you can get is only valid for 90 days. So - if you have the possiblity of work lined up, great - simply wait two weeks to get your SSN and away you go. However, be prepared that the 90 day allowed work period will probably expire before you either get your EAD or greencard in hand.

I did it though - and it was well worth it.

I got mine (even though I knew at the time that Oklahoma City was breezing through their AOS list) just because you just never know when you will hit a snag. I humbly point to rebeccajo's husband as a case in point, you just neber know who will get stuck in namecheck purgatory.

Really? I didn't realize it's that slow now. I thought I read people were still getting it on average a month after applying. Well if it's taking that long now, yeah I guess the temp thing then. I didn't even realize there was a temporary EAD. Shows you how out of date I am I guess...

Heh, yeah, EADs are that slow now! :) I applied for one in case I hit a snag with my AOS.

Yeah, the temp EAD is only for K1s and only if they get the stamp at a POE. Don't ask me why K3s aren't work temporarily work authorised... I wish they were!

They sure didn't give me one in Blaine, WA. I asked he said he would get me the form so that I could file for my EAD... LOL... it was worth a shot.

As you can see from my timeline I filed for my EAD. I hope that it was a waste of our money and we get my GC before I'm approved for my EAD.
