Guide me please about IRS reciept for AOS...

Hi dear VJs!

My USC wife is my petetioner but she havent been living in US for last six years. Our petetion has been approved. Now gonna submit Affidavit of support. With AOS you need to sumbit IRS reciepts of federal tax returns. My wife havent been working and didnt do any federal tax returns as she was overseas and havent been working. What should we do?? We got a joint sponsor and got his federal tax returns and W2s etc but worried about supporting documents of my wife with her Affidavit of support. Please guide us. Would be much appreciated. Thanks

It doesn't matter if she was overseas. She's a US citizen so she needs to have filed her taxes. Your options are: 1. File all her taxes now; 2. Get a letter from the IRS stating she was exempt from filing taxes (I don't know details about this but this does apply to some people). If you have a tax person, make an appointment immediately so they can help you sort this out.

She doesn't need a letter from the IRS.  If she hasn't been earning any money, she is exempt from filing tax returns.  In the tax section of the affidavit of support, simply hand write, "Not required to file.  Income below threshold."  That will deal with the tax issue, but not satisfy the sponsorship requirements.

Facts are cheap...knowing how to use them is precious...
