B2 denial and K1 interview

Timeline

Recently approved for 129f; however fiancée was denied B2 tourist visa about 2 years ago. At the time, we had met 2 months prior. In her interview for the b2, She said she wanted to travel to the US and that she didn’t know anyone in the US (her friends advised this). She was denied. I am now worried about this because according to our evidence of relationship, we met two months before this. Will this effect our k1? Does anyone have any advice or recommendations? I may contact an attorney but I would love to hear everyone’s input. Thank you.

It probably won't come up. I assume she wasn't denied for misrepresenting herself- correct? Just the standard type of rejection? 

 

My recommendation is not contact an attorney and for your fiancee just to be honest during her K-1 interview. She should answer whatever she is asked truthfully, but also just answer what is asked and not provide more info than is necessary.

And if they ask if she was originally coming to see me when she was trying to procure a tourist visa? She should say yes, even if that suggests she was lying during her B2 interview?

Like above.. it may not come up; but they do have it on file so they can see it.

 

Generally B2 denials are not an issue at all as it's common really; but the fact that she did lie on it saying she knew no one in the US... that, if they want to look at it, is misrespresentation... so yea, it might not even come up; but if it does it can be bad definately. At this point can't do much but just go into the interview and be upfront and honest if it comes up.

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

It likely was not a material fact in her denial. As such, it shouldn’t be an issue for the K-1. If they do determine it was a material misrepresentation then she would have a permanent bar on any visa, but you can file an I-601 hardship waiver. This happens after the interview. The only way to know for sure is to go through the process and interview.

 

I doubt it will be an issue, but be sure to be honest at all points when dealing with immigration. Never lie:..it can make your life much, much harder.

 

No attorney is necessary IMO. If an I-601 is needed, then that’s where bringing one in to help present a good waiver case can be helpful.
