REF: Legal Termination of Marriage / German divorce degree

 

Hello

In June my fiancé filled the I-129F and today we did receive following REF:

"Submit a legible photocopy of the legal termination of marriage of (my name) and (my ex husband).

Such proof would normally be a final (absolute) divorce decree .... In order for the legal termination of a marriage to be considered valid for immigration purposes, it generally must be valid in the jurisdiction where it was terminated. In addition, the divorce must also be recognised in the jurisdiction where any subsequent marriage occurred.

Note: A divorce Nisi is not considered to be evidence of a final divorce. "

In the I-129F we did provide the standard German divorce degree which you receive from the court after the divorce is final.

Its called a "Beschluss" which was translated as ´Ruling´ which the translation office told me is correct. This paper clearly says ... "marriage register no.xxx is hereby divorced". I really don't understand what else they could possibly want to see?

 

Any ideas?

If there is other divorced Germans here ... what did you provide?

Did you provide a scan or a wet seal copy?

Well, my was translated as 'decree' and supplemented with an additional 'ruling' which is correcting a mistake in the main document. However, I very much doubt it's about the translation. What I would do in this situation, I would enclose a certified copy of the document with translation and probably an affidavit from your divorce attorney stating this one is final and why.

A scan and then printed. I had my divorce certificate translated here in Germany and then I did a scan of the original german document and the translation document and sent it by mail to my fiancé. he printed everything and attached it in paper form to the I-129F.

 

I think the problem is not the scan or copy .... they say its a "nisi" whatever that means and that its not considered to be evidence of a final divorce.

Congratulations! I was the same I checked the cases and the K1 case before and after ours was approved yet ours was still showing just "received" them BOOM! 😄 Congratulations!

If the text and the translation were not sewn together they could have misplaced them. My were firmly attached to each other. But we haven't received any feedback yet. What comes to my mind, USCIS is not sure for whatever reason that it is final and/or concerned about it's validity in Germany. Were you both German citizens and permanently residing  in Germany when you divorced? Is your decree from a German court?

Yes my ex husband and me both German citizens and it was a German court. I'm not sure what to think ... I mean there must be more germans that had already an divorce and providing a German Divorce Certificate. There really is only this one document that you receive from the court with a big round stamp on it from the court.

 

Maybe an affidavit from the attorney is not a bad idea.

Nisi is a conditional decree, a final decree must bear an uncontestable date of coming into force

I'm not sure this will answer your current dilemma but you'll need most of this for interview preparation. Also, go over to the sub-forum for Germany and ask some of the folks there as they may have a better handle then us who know very little about the processing in Germany of your case.

It does make sense to me but I have been here for years and understand the process as you are moving along with some information but not 100% of the information needed to understand what is involved. This is one big process. It runs on their time and not ours. Once I figured that out I no longer had any anxiety attacks that you are experiencing.

 

This is an old saying I learned a long time ago. The man who has the gold makes the rules. So until I get the gold, I have to abide by "The Man's" rules. Just the way life is.

Here is a link that explains in layman's terms what a "divorce NISI" is. https://www.mass.gov/service-details/finalizing-a-divorce You may or may not have sent them the final divorce decree but the NISI. Double check your paperwork to see if you can determine which it is. If you feel you sent them the document that they are looking for, try and get and endorsement that explains what it is that you are submitting. Just my 2 cents.

Just wanted to share that I just got a text that my case just got updated. Went to check and got a request for additional evidence...its very bitter sweet....more bitter than sweet but like someone here said before "at least someone looked at my case". I have no clue what i could have possibly have missed and I did over 40 pages with 3 or more picture front and back so we will see! Is there a way I can call to see what they need from me?

 

They are definitely digging into June guys! :)

 

Trying to be as positive about it as I can! This process is exhausting!

Call USCIS. Tell them you would like a copy of the RFE because you are on a deadline that can’t be extended. A tier 2 is the only one that has access to those systems. They can also read it to you and let you know what they are requesting. 

 

Also there is some history from others. Here on VJ they have created a spreadsheet where couples have added their RFE information and it makes for a good primer while you are waiting for your RFE.
