Is he a full-time student?
U mentioned community college - I don't think it matters WHAT type of school he's at?
He can show proof of tuition paid and classed enrolled in.

I don't mean to be rude but if he's a student, how is he visiting until you get NOA2? U do know that's at least 4 months out...
Are u saying he's "supposed" to be employed (but is unemployed at this time) but takes classes on the side?
if so, yes. U are correct - visiting is always a risk since immigration officer can turn anyone away at any time at the borders and it doesn't sound to me that he has enough to show he's connected back to Korea.

We understand that we still have a while to wait but it would be nice for him to at least visit until close to the time. We already know about the 90 day (89) limitation. He decided to take some skills courses at a local community college instead of looking for employment once we decided to file the K1. I just worry that because he's unemployed now, it isn't enough to prove his home ties.

Like above, proofs of paid tuition and enrolment. Some scheduled exams, that he has to come back to Korea.

I don't know much about VWP program but as far as I am aware what I as a Polish citizen have to proof at the Embassy a citizen from the country with VWP sometimes have to proof at the US airport. And yes you are right, those are firstly ties to the country (Korea), enough money to cover visit expenses and last but not least a reliable storyline. Unemployed student, that is visiting his fiancee for couple of months is hardly believable. He already was taken for a secondary, you gas better prepare more :)

Well if he wants to visit for like a few weeks DURING the application process, he certainly can
But your worry is noted- he has to find something to proof home ties. Have you guys considered him getting some type of a job in the meantime?
Because unfortunately, unemployed with a fiance in America does not look good to any immigration officer.

I wish you guys luck!

I think that we've agreed because of the cost of the tickets and the uncertainty, we will just wait. He will be in school until December and he may end up looking for a short term job while we wait the rest of the time.

Some great stories! I hear March applicants are starting to be approved so that means we got two- three more months until we start seeing us juney’s (I just came up with that) getting approved. So excited to get 2018 over as it’s been both tough and life changing (for the better)

Yep! And apparently uscis announced last week that they were going to transfer cases to other service centers to balance the workload. So hopefully this means we’ll see approvals a bit sooner than we anticipated.

Unfortunately I read that as having more people in the California centre which means that it may take even more time.

Interesting. I thought some of our petitions could be transferred elsewhere as well based on the portion below. Hopefully there’ll be more detailed info about what they’re doing to clarify.

Which cases/petitions are transferred to a different USCIS Service Center?

  • I-129F, Petition for Alien Fiancé(e)
  • I-140, Immigrant Petition for Alien Worker
  • I-485, Application to Register Permanent Residence or Adjustment of Status (employment and asylum-based only)
  • I-821D/I-765, Consideration of Deferred Action for Childhood Arrivals/ Application for Employment Authorization (initial and renewal requests)

CSC looks already suffocated with workload, so hardly any relief. Also, what happens if you are up to your head with files and more arrive? You do what you have initially  scheduled to do and deal with newly arrived stuff when you have time/feel like it etc, this is purely human nature. Also, if files are physically transferred from one location to another in large quantities, human errors are likely to occur. Yes, I am quite sceptical that it will have any speed-up effect :)

I’m surprised everyone has such a negative disposition on this. Anything that uscis does to address the growing backlog and processing times is good news in my book. I’ve often wondered why aren’t they doing anything to work more efficiently. But they are and to me, that’s a positive.

If you have a huge workload, limited staff, a procedure to follow which is not strict, to become speedier you have to hire more people, file less petitions or implement strict timeframes. If you want to become more efficient, you must assign the existing workload to all staff readily available and review your policy with a risk-based approach. From what path2usa link says, I can conclude that nothing like I listed above happens. Instead, they are getting Vermont out of play regarding a whole lot of petitions including I-129Fs and distributing its workload between already busy California and Nebraska. However, from what I have read, Vermont deals with very case specific files, and they are a few, so Vermont approvals of I-129Fs were quite speedy if compared to CSC and NSC. So I dont't therefore expect additional workload to significantly hinder CSC and NSC. Looks like Vermont was doing Premium processing, it's now cancelled hence the teansfer.

Hello June Filers! I am new here (also a June filer)...I have a quick question for you all. Sorry if this is a dumb question...I am still learning this processing stuff!

Anyway...I have noticed that people's entry to the US AFTER they have received their visa varies drastically....I have seen some in which the person doesn't come until 2 months past receiving visa.

Is there a reason for this?? Is there a time line you have to wait after getting the visa in hand ( I know actually getting the visa take a few days, but I want to know once you actually have it, do you have to wait for something?)

Can you get a visa in hand a come to the US the day after?

God Bless!
