What outcome are you referring to that would be the same? Outcome off getting into trouble by lying to the cbp officer about their actual intent?

the biggest issue here is how easy it was to circumvent the whole process of CR-1 and just do AOS because some one just "changed" their mind. Some of us, didnt get that choice and even if we did, didnt take that shortcut and skip the line

5/24/2018                  Marriage license, officiant and certificate / applied for SS#

5/31/2018                  AOS/AP/EAD

6/7/2018                    email notification of NOA-1

6/11/2018                  NOA-1 hard copies for AOS/EAD/AP

6/27/2018                  Biometrics for AOS/EAD

7/7/2018                    ready to be scheduled for interview

7/11/2018                  We are still reviewing your case and there are no updates at this time (email from USCIS)

8/22/2018                  We are still reviewing your case and there are no updates at this time (same email again)

9/5/2018                     We are still reviewing your case and there are no updates at this time (this is getting boring!!!)

10/3/2018                  We are still reviewing your case and there are no updates at this time (this is insanity, 4th time while some got GC)

10/17/2018                After 136 days of wait in HELL, finally EAD in production

10/21/2018                Card was mailed to me, and yes it said so on a Sunday night, while Vj-ing

10/22/2018                Card was picked up by the USPS

10/24/2018                EAD in hand. F%^&& finally

12/28/2018                Interview has been scheduled. Waiting for notification with date by snail mail

It's not an issue at all. Why are you bothered that one couple won't be separated for a year because of red tape? Let them enjoy their lives.

Great, the next time I hear someone need helps i'll just refer to an easy "legal" way. Just get a Visa or use your chance of getting here and adjust. What a visajourney! What's the point of this whole website then?

Adjustment of status is as legal as requesting a visa.

Sorry, I wasn't assuming you specifically were using a lawyer for those reasons. I was just making a general statement about people who DO think that lawyers get them the VIP treatment. =) Your CR-1 plan is sound and you guys can still visit each other! The payoff is worth the wait too, in my opinion and if you have been doing the back-and-forth thing already, one more year isn't too bad in the grand scheme of things. Good luck and keep us posted!

But it's still illegal. A perceived lack of a victim has no bearing on whether it is right/legal/whatever.

Misrepresentation is not allowed, however there is nothing restricting anyone from changing their minds.

Not really. Getting the visa and getting past the port of entry is not easy. If they will find out (and they will try hard, trust me), the outcome would be Denial of a visa or entry.

What you did or did not do is none of other people's business. It is NOT "easy" to get a non-immigrant visa and get past the port of entry. An entire industry of bureaucracies work to prevent fraudsters from obtaining visas and entering the country.

How does one (cbp/uscis/etc) know there is a misrepresentation when they are saying they changed their mind? Or is it just based on trust?

As far as I know, they don't have mind readers yet.  That being said, they catch liars everyday at the border...
