I-751 June 2018 Filers

Sadly, our marriage is ending, possibly before the I-751 application is approved. We are already separated but processing the divorce may take months, so we cannot predict if the divorce will be finalized before or after the I-751 approval. My spouse is the petitioner and she attended her biometrics appointment without me last week. She has an expired green card and the 18 month extension letter.

 

I am willing to help her continue the journey (within the confines of the law) if she chooses to do so and I'm told she can still be approved for the I-751 if the marriage was in good faith - and it was. We have been married for three years last January and until last week were living a typical married life; co-habitating, shared insurance, renting apartment together, etc.

 

Does she need to take any action now, prior to the finalization of the divorce? My understanding is that if the divorce is finalized before the completion of the I-751 she will need to contact USCIS and probably submit a waiver or resubmit the I-751 application with a waiver.

 

If she ends up scheduled for an interview I will not be attending the interview with her regardless of the finality of the divorce. Am I correct in assuming that would doom her application? Does she have any recourse if an interview is scheduled before the divorce is final?

 

Neither of us are in a financial position to secure counsel.

 

If these are inappropriate questions for this thread, I will remove this post and repost in the right place if someone can tell me where that is.

I searched the forum but couldn't find the answers to my questions but it is possible I overlooked something.

I am sorry to learn of this with your marriage. It is never an easy road but to have all of this combined can become extremely stressful.

I try to log on at least once a week but I have started getting these types of emails from Visa journey with Timeline updates:

It feels like CSC is slowing down. The approvals seem to be happening faster at Potomac center.

Many applications have been dispersed to other centers due to heavy workload out of CSC. Hang in there....your time for approval is coming.....speak it into being!

CSC originally and our case was transferred to the Potomac Service Center on 3/15 as well so hopefully you will be hearing something soon too of Potomac is moving quickly through the cases that got transferred to them.

Hey Amadia, yeah I think a handful of us started getting these after they transferred cases and updated something on the website, I found it annoying and just logged into the uscis account and went into the settings and turned off the no updates notice so it would stop sending those. 

 

Not sure about the Visa Journey timeline one though as I haven't paid attention to that.

I have received zero updates since doing my biometrics last July which they haven't even updated on the USCIS website, ughhh.

lol, just got another notice that they took action so logged in and they updated it that they approved our petition yesterday 04/17/19. Me thinks whoever is doing the updates forgot to do that one before the card is being produced one. IDK what is going on with the website updates but they are definitely out of order lol.

From what I understood they transferred I751 cases to other centers because of the backlog.

Yeah, I'm not comfortable with giving this out, sorry. And we advise people to mask this out as well as other personal info when they post screenshots of their letters and whatnot for security reasons so please don't ask people for this info.
