USCIS, along with U.S. Immigration and Customs Enforcement (ICE) and U.S. Customs and Border Protection (CBP), has legal authority under current immigration laws to issue NTAs. This Policy Memorandum updates the guidelines USCIS officers use to determine when to refer a case to ICE or to issue an NTA. The revised policy generally requires USCIS to issue an NTA in the following categories of cases in which the individual is removable:

Cases where fraud or misrepresentation is substantiated, and/or where an applicant abused any program related to the receipt of public benefits. USCIS will issue an NTA even if the case is denied for reasons other than fraud.
Criminal cases where an applicant is convicted of or charged with a criminal offense, or has committed acts that are chargeable as a criminal offense, even if the criminal conduct was not the basis for the denial or the ground of removability. Troubling?

This is definitely troubling but I also think that one other important purpose of this type of policy-making is to create fear. To depress the rate of N400 and other applications could be the end goal.

HELP!! Suggestions/insight please!! Happy we received NOA (18 months extension) BUT it says “page 1 of 2” and page 2 is MISSING!!

—What the heck was on page 2???

AND... there was an extra page in the envelope, a NOA for someone else’s I-130!!!

—Good grief, has this happened to anyone else?

—Did someone else end up with my page 2?? (Please send it LOL)

I’ll call USCIS tomorrow, ask for my page 2 & if should I send on the other persons’ NOA.

I’ll call USCIS tomorrow, ask for my page 2 & if should I send on the other persons’ NOA.

My wife's page 2 was nothing fantastic there were 2 paragraphs: "Return of Original Documents" and "Notice". "Return of Original Documents just said "Use Form -G884 to request the return of original documents submitted..." Notice is "Under the Immigration and Nationality Act, the information you provide on and in support of applications and petitions is submitted under the penalty of perjury..."
