Hello All.

 

I'm at the medical stage on the K1 visa process and now researching the interview stage.

 

I came across this part regarding Birth Certificates and its kind of thrown me a little

 

I have two children from previous relationships who are not coming with me.

 

This is the requirements on Birth Certificates.

 

  

Birth Certificate: Obtain the original, or certified copy (provided by the issuing authority), of the birth record of each family member (yourself, your spouse, and all unmarried children under the age of 21, even if they are not immigrating with you.  If the children are deceased, so state giving year of death). Note:  We will not accept the short form version of a UK birth certificate.  The certificate must list both parents’ names;

If your birth certificate is unavailable you should obtain a certified statement from the appropriate government authority stating the reason why the record is not available. With the certified statement you must obtain secondary evidence. For example:

  • An affidavit from a close relative, preferably the applicant’s mother, stating the date and place of birth, both parent’s names, and the mother’s maiden name.
  • An adoption decree for an adopted child; or
  • A baptismal certificate that contains the date and place of birth and both parent’s names providing the baptism took place shortly after birth.

 

I can understand the Birth Certificate for the child (I have no idea why thou) but have no clue for the spouse, what does that even mean?, clearly I have no spouse, do they mean the child's Mother?, in not married yet so that cant mean my partner in the US or have I just got this all ####### about face and just need my Birth Certificate.

Does it says ex-spouse? Does it says ex-partner? No. It's just an example the "spouse " . If you don't  have a spouse than it doesnt apply to you. 

 

You need your and your children birth certificates, like it says.

[11/21, 2013] - Day 153 SSN and 10-year GC in hand

Correct Blessed, if you could tell me in which circumstances you would have a spouse while applying for a K1 I would be most greatful......applying rocket science of course.

It would be applicable if you'd be applying for spouse visa. The documentation for interview is pretty much the same for both visas so you just decide what's applicable to you.

You will find that the London website tends to lump instructions for many visa types together, so understand that forms and lists are often multi-purpose and not written only to your situation. 

 

And you will find that in reality, they are not going to need birth certificates from those children for your K1. They also will tell you to bring photocopies of each original document you provide. They quit taking photocopies at least two years ago. 

 

Suggestion--get all your shots done or documented before you attend the medical appointment so they can be signed off. Otherwise you will have to pay another approved doctor in the US to sign off.
