Yes marrying and returning to the U.S. with the intention of adjusting your status to permanent residency is fraud and if discovered you’ll be denied entry and have to leave the U.S. since you can’t be an intending immigrant seeking admission on a non-immigrant visa. If that happens your only cause of action will be to stay out of the U.S. until an immigrant petition is filed and you receive your immigrant visa. A safe option since you’re already in the country is to do a local civil marriage in court, apply for your adjustment of status together with your advance parole, get advance parole within a few months then leave the U.S. by then to do an “official” big wedding celebration outside the U.S. Upon return to the U.S. you’ll be admitted as a parolee to continue adjustment not F-1.

8/18/2014: Accepted in Chicago. Transferred to Nebraska Service Center.

8/21/2014: Received NOA 1. I-130, I-485, I-765 in mail.

8/25/2014: Received biometrics in mail. Scheduled for 9/8/2014

9/24/2014: EAD approved. 36 Days!

10/01/2014: EAD mailed.

10/03/2014: Received EAD card.

10/14/2014: I-485 moved to testing and interview.

1/28/2015: Interview scheduled for 3/4/2015.

Thank you for your help. Is it still a problem if I continue my studies as an international student and get married at the same time? Because we both are so exited to go and we got our tickets already. Also the ceremony is going to be here in America not in my country. We’re just going for vacation and meet my family.

A better suggestion is to postpone your vacation and get married now and do AOS as posted above. Get married in the courthouse here in the US and file for AOS and wait for AP. The moment you step out of the US and come back with the intentions to marry...you have committed fraud, since you are on a non-immigrant visa.

Not a problem to be a student and get married. It’s perfectly fine and legal. With that being said the catch 22 is that having a spouse who is a U.S. citizen makes your claim for a non immigrant intent weak when seeking admission to re enter as an F-1. Remember admission is at the discretion of the CBP officer to determine if you’re a genuine student who will depart the U.S. after your studies, and this puts you in a tight corner though not necessarily make it impossible. That’s why to be on a safe side, postpone your vacation and do as I suggested above so you’re not walking on thin ice.

If a person enters the US via an F-1 visa, isn't that person stating "non-immigrant" intent?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Exactly! And that's a tough one to prove with a USC fiancée who has no intention of relocating to their foreign lover's homeland.

No on the other hand anything “intense” will be with the CBP officer instead trying to convince you’ll depart the U.S. after your studies and not adjust status through your spouse. Intent by law is determined at the border and once you make it through you’re good to adjust by then. The Bureau of Immigration Appeals made a ruling on this in Matter of Cavazos.

Misrepresentation can be determined after entry into the US.
