Canadian Marrying US Citizen without K1 - AOS?

Timeline

My fiancee and I are planning to get married in November. I understand that it is 'legal' for me to get married in the US if I am returning to Canada. However, someone told us that I could stay in the US and apply to Adjust my Status. Is this possible without having a K1? I've heard it is referred to as "visa fraud". Has anyone heard of people having success doing it this way? 

 

Our other option is for her to return to Canada with me and apply for my CR1 visa from here; she has property, bank account, SS and license still in the States.

yes, it is a visa fraud. No one here will give you advises for it.

 

Either do K1 or CR1. Those are your two legal options.

It’s always fraud to come into the US with the intention to immigrate on a non-immigrant visa.  People sometimes “get away “ withi it, but the flip side is you can get a lifetime ban.  Once you start off a visa application with a lie, you can paint yourself in a corner you can’t get out of.  They are somewhat adept at sniffing that out.

Thanks; I had my suspicions that it might be fraud.

 

So the question then is if we leave for our honeymoon from the US and return (after which we will drive back to Canada) will I have an issue re-entering the country? i.e. Can they see that a marriage license has been issued with my name on it?

You can visit afterwards, as long Astros you don’t intend to stay yet.  You can visit while your application is pending, though pack lightly and you may want to bring a current lease or recent pay stubs to show you aren’t moving.  Important at this stage: don’t lie.  Don’t say you aren’t married.  CBP notes are accessed as part of the visa vetting.
