How long can the case sit at the NVC before they require additional documents like a letter of intent from me? My fiance is trying to get his police record done, but his work has caused a delay in him being able to get it done. He does not have a scanner and will have to post everything to ACRO.

Do you mean sit at your embassy?

The NVC will ship it to your embassy with in 2 to 8 weeks and then it will be up to you to proceed with the embassy's process.

How long can be answered by your NOA2. It will state your expiry date (4 months) from date of NOA2 and you must proceed with moving forward with the embassy procedure. If you do not your Visa will be terminated.

NVC doesn't require additional documents as this is a function of USCIS. Do you have an RFE pending that you are trying to answer? You are little all over the place with your statement, hard to determine where you are in the process and why you are at the NVC stage and your worrying about a letter of intent? Like to help but till I am unconfused I have to sit this one out.

I do not have an RFE. Our package is at the NVC and I have an NVC case number. I was asking if there is a deadline of submission to documents to the NVC? My fiance is a self employed carpenter who just got a load of work and is trying to finish quotes and work and this is taking time away from him getting his stuff together to submit for his criminal record check. It is not simple because he does not have a scanner to load documents he will have to take time to go somewhere to have that done.

Nothing gets submitted to the NVC. There are documents required to be brought physically to the interview so you have time to prepare those. The P3 and the P4 will outline exactly what documents you need to bring. Find out the timing on how long his criminal record check will take to process and receive in the country he is from (and any other country he has lived in for a continuous 6 months after the age of 18 as he will need one from that country too). Some PCC's take a long time to receive so check that out right away. Just note what I explained in my post above regarding the expiry date of your NOA2 as posted above.

I think you want to know how long do you have before you have to complete the interview at the Embassy. You have one year to complete the interview. Your timeline is 4 months at a time, then you request another extension for another 4 months. It's entirely up to the CO to determine if in fact you have a reasonable request and you are still free to marry to grant you an extension.

Any document that is going to take time for you or your fiance(e) I would hope you would get the paperwork rolling on that as things like police clearances can sometimes take 2-3 months from some country's.

From the DOS K-1 Petition Regulations

9 FAM 41.81 N6.2 Validity of a K-1 Petition

(CT:VISA-2165; 08-21-2014)

An approved K-1 visa petition is valid for a period of four months from the date of USCIS action and may be re-validated by the consular officer any number of times for additional periods of four months from the date of re-validation, provided the officer concludes that the petitioner and the beneficiary remain legally free to marry and continue to intend to marry each other within 90 days after the beneficiary's admission into the United States.

If you have additional questions please ask.

Keep calling, once a day is enough, eventually they will have your case number.

First, you are in a normal cycle and path of getting your approval. There is nothing unusual at this time about the progress you are experiencing.

The letter of intent is only needed if your Embassy so states in there Packet 3 letter or better referred to the list of documents needed for the interview. If it is required then use the one you submitted to USCIS with your I-129f and just change the dates and address to information. Resign by both of you.

Hope this helps.

yup :)

There are ten Federal Holidays recognized by the United States Government. On these days, all non-essential government offices are closed (including post offices) and many federal employees receive a paid day off. USCIS is a non-essential government office so both NVC and USCIS will be closed in observance of Independence Day July 4, 2018.

When is the Next Federal Holiday?

The next federal holiday is Independence Day. Independence Day is 0 days away and will be observed on Wednesday, July 4, 2018.
