I am the US Citizen and my wife is a foreign national living in her native country. Recently my wife found out that she is Hepititus b Positive. She is following up with the doctor who decided that she needs no treatment so far. I am vaccinated and I tested negative for it. I am applying for her with the USCIS as my spouse (form I-130). Will the fact that she is Hep b positive cause her denial to get the non-immigrant visa after she goes to the medical?.. Please help!

My understanding is no, but read for yourself.  https://www.uscis.gov/policymanual/HTML/PolicyManual-Volume8-PartB-Chapter6.html

 

However, there is no "non-immigrant" spouse visa.  She'll be applying for an IR1 or CR1 "immigrant" spouse visa.

Facts are cheap...knowing how to use them is precious...

There is a non immigrant spouse visa. It’s a k3 visa but one must first file I-130 for immigrant spouse ir1/cr1 and then I-129f for fiancé visa-(already married) so they can come here faster in my understanding

It's a common misunderstanding, but the K3 visa has been virtually obsolete and unavailable since February 1, 2010.  Now, if you file both petitions, USCIS simple administratively closes the file on the I-129F for spouse in favor of the I-130.  The visa "exists" technically, but is not a viable option.

I would see what the doctor says. If she is positive for the antibodies it can just mean she has immunity.  Was she possibly ever vaccinated?  She will always test positive for antibodies if she was which is actually a good thing. Health workers are given the vaccine as a welcome to your job physical. 

 

I have iron overload which makes me susceptible to liver diseases and I was vaccinated against Hepatitis B. I will always show positive for the antibodies.  Though I can never get it.  Knock wood! 

 

Find out what it means but even with an active case, it shouldn't be a deal breaker.  It's not airborne and usually resolves without treatment (she could have also have had a mild case, not realized it, and will also test positive for antibioties the rest of her life, also an overall good thing).
