OK, I'm trying to think ahead. A job for my husband is no problem once we get him here on his K3. Does anyone know if the K3 Visa gives him the documentation to work? (Well...after about a week or so of snugglin' anyway!) Or is there more paperwork? We're getting married again in the US (since my family missed our wedding and would like to see us married in a full blown church/gown/tux wedding) and weddings are expensive!

You are looking at a little more paperwork before your hubbie can work.

He will need an EAD card (employment authorization documentation) which you can apply for together with AOS or separately. How long this takes depends, normally about 3 months. After he receives his EAD card, he can apply for a social security number at the SSA.

Maybe the guides would help you (if they work again)

Three months? Geeze! He's going to go nuts not working for 3 months. He's going nuts now. There aren't any jobs in Nicaragua. Oh well....he can do the dishes, make me breakfast in bed every morning, clean the house, and do the laundry! More importantly...give me a daily massage! Sounds like a plan to me!

I'll keep him busy.....with something.:innocent:

K3 allows one to travel outside of the US and then come back -- it's really the only advantage over K1. Like K1 holder, your husband would need to file for AOS and EAD.

09-02-2005 Applications for AOS, EAD, and AP received by MSC

10-21-2005 AOS fingerprint notice for 12-08-2005

11-07-2005 AP approved

12-05-2005 Infopass appt at San Jose office for interim EAD -- Refused, because it is already approved by MSC on 11-07-2005

12-07-2005 Attempt at interim EAD at San Francisco office -- no go. Back to San Jose, where CSO (chief station officer) tells they will contact MSC via email to request permission to issue interim EAD

12-08-2005 Biometrics for AOS and EAD. Having no EAD appt letter was no problem (used EAD NOA)

12-15-2005 EAD arrived in the mail

12-24-2005 Received interview letter; interview scheduled 03-01-2006

01-28-2006 Received replacement SSN card in married name (5 wks since application)

03-01-2006 AOS interview -- approved; received stamp in the passport

03-13-2006 Green card arrived in the mail

kc,

No, a K3 does not need to file for AOS, and many do not.

Might I suggest he looks into volunteering? My dh went absolutely stir crazy being stuck in the house, not driving, etc etc etc. So, he started volunteering for the county. In addition to getting him out of the house, he now has good references in the United States and he has a few job prospects once he gets his EAD.

What a lovely idea! Now only 11 days 12 hours and 42 minutes til his interview! Then I'll start looking into the volunteering. I'm stressing about it more than he is. I think I may look into a day spa package! I need a massage now! I'm wound up so tight, I think my spine is going to snap in half.

Yodrak,

Please explain further on: "No, a K3 does not need to file for AOS, and many do not."

Does you mean the beneficiary continues with the I-130 process and travels back to his country for the interview at the consulate?

To anyone who knows:

How long after getting into US on a K visa can one qualify to apply for a Driver's License (the applicant is licensed to drive in his country of origin). I am referring to what documents the DMV will require.

Thanks!!!

to apply for a driver's license one needs to have his/her SSN.

The different states handle this whole thing differently though and you should find out the rules for it for your state. I don't have the link right now and I'm sorry for that. But you could try googling or something.
