Hi,

Me and my wife(US citizen) are currently preparing the I-864 and I864-A forms for NVC to get our CR1 visa but we are not sure which of the forms I-864A and I-864 we should submit.

My wife's mom will be our sponsor. Her parents are filing their taxes jointly and they both have the same address as my wife (household members).

We are about to submit the following forms:

  • I-864 for my wife
  • I-864A for my wife's mom ( household member 1)
  • I-864A for my wife's dad ( household member 2)

Do we also need to submit a I-864 for my wife's mom(and dad?) in addition to her I-864A  or is this correct?

Thanks!

I believe it would be:

  • Wife - I-864
  • Wife's mom (joint sponsor) - I-864
  • Wife's dad (spouse of joint sponsor / household member) - I-864A

Yes, if a joint sponsor is needed.  If the wife qualifies on her own, then just one affidavit from her.  If it's Employment income, the I-864EZ will be fine.

Just living with parents does not mean they need to sign and be obligated by an affidavit of support.

ONLY, if ALL THREE incomes are needed to qualify, would the original idea of I-864 from wife and I-864a from each parent be the way to go.
