relatives in love?

I think the OP is talking about a marriage between a man and his first cousin's daughter or marriage between second cousins. I do not know of any state that prohibits any other cousin marriage except between first cousins.

President Franklin roosevelt married his second cousin Eleanor Roosevelt and they had the same names when they began engaged- Both were Rossevelts by birth.

I do not think this is a problem for USCIS.

Such a relationship is not permitted for the purposes of marriage in some US states.

Marriage among cousins allowed:

Alabama, Alaska, California, Colorado, Connecticut, District of Columbia, Florida, Georgia, Hawaii, Maryland, Massachusetts, New Jersey, New Mexico, New York, North Carolina*, Rhode Island, South Carolina, Tennessee, Texas,

Vermont, Virginia

The law in Texas has changed. First cousins are no longer allowed to get married under Texas law.

hi guys!i am here again wishing that my question would be answered.i am asking in behalf of my cousin who is a US citizen. the story began when two years ago he fell in love with her nephew, daughter of her cousin. now he's planning to file a Fiance visa for her nephew since they are in loved with each other. the problem is they have the same middle name.do you think immigration would question that?is it advisable for them to undergo fiance visa or does my cousin would have better chance if he'll marry her girlfriend in the Philippines?thanks in advance.im looking forward to your responses.have a pleasant day to all!!!!

Clarification (simplified - no divorce/remarry etc.):

Niece (female) and Nephew (Male) are the children of your sister or brother.

Cousins (female or male) are the children of Aunts or Uncles - the children of Cousins are always still Cousins (2nd, 3rd-removed, etc).

The way I read it..... :wacko:

He: USC

She: Non-USC and Second Cousin to Him

They: Fall in love, want to get married - She has same middle name as Him.

Question 1: Will immigration question having same middle name?

Question 2: Is it advisable for Them to undergo a fiancé visa?

Question 3: (Translation 1) Would they be better to marry in PI (instead of K1)?

Question 3: (Translation 2) Would He be better to marry Her girlfriend (someone entirely different) in PI?

No, it depends on what state the cousin would like to get married in. One does not have to marry in the state where they live.

One does, however, have to get divorced in the state where they live, which could create a complication under the right set of circumstances.

As you can see, there are many states where marriage between first cousins is not allowed, but a significant number of states allow it, so it depends on what state your cousin lives in. .....

That is correct. Marriage between these two individual's is allowed in all 50 States. It's a good thing they are not in love in China though. :no:

Their genealogy is not a problem. They can simply make their choices and proceed as if they are not related.

It's not a second cousin, it's a first cousin once-removed.

Second cousins have the same great-grandparents, but not the same grandparents.

The children of my first cousins are still first cousins, but separated by a generation, hence once-removed.

I am not sure, but I would think that the first cousin rules would apply.

Hmm....I betcha that I'm related to all of you guys. However, the records and history is unknown. I can prove it genetically.

Yes, but they need only marry (not live) in a State where it is legal. They may proceed with the visa process as if their genealogy was not a factor.

That's been debated here on VJ many times, and I'm not so sure you're right. It usually comes up with the issue of divorce and certain states having mandatory waiting periods. I don't think there's ever been any solid conclusions.
