hi guys!i am here again wishing that my question would be answered.i am asking in behalf of my cousin who is a US citizen. the story began when two years ago he fell in love with her nephew, daughter of her cousin. now he's planning to file a Fiance visa for her nephew since they are in loved with each other. the problem is they have the same middle name.do you think immigration would question that?is it advisable for them to undergo fiance visa or does my cousin would have better chance if he'll marry her girlfriend in the Philippines?thanks in advance.im looking forward to your responses.have a pleasant day to all!!!!

You seem to have a problem with personal pronouns, which makes your post a tad confusing. In any event, your cousin might want to check the marriage laws of whatever state he might wish to get married in to see if marrying a niece is allowed. (A man marrying his nephew isn't allowed, except perhaps in 1 or 2 states.)

If as you say this is your cousin who wants to marry his niece....isn't she also your niece? Or is this the other side of the family?

I've attempted to correct the first part of your post to make it more understandable. The answer to the initial question posed by the OP depends on what grade the familial relationship is, 1st or 2nd cousins. Yes, your cousin check w/ the state you live in to see what are the rules governing marriage w/in families.

The part in blue, is not clear at all. Whose girlfriend would he marry, does he have another girl also? Or are you saying would he have better luck at getting a visa if he marries his niece in the Phillipines and tries to get a spousal visa for her? I don't know the specific answer to that, but I'm sure there are rules in the Phillipines also governing marriage between family members, which may or may not be more strict that those in the US state your cousin lives in. A little more research on your particular case needs to be done. You may also want to consult a qualified immigration attorney, if you feel you need further clarification.

Please elaborate more about your cousin and his girlfriend. Are they 1st or 2nd degree cousins? I know that those in 1st degree are not allowed to get married here according to our Philippines laws. Your cousin should also check the state where they plan to get married too. I think it would be best to ask lawyers.

Thanks for clarifying. Such a relationship is not permitted for the purposes of marriage in some US states.

Marriage among cousins allowed:

Alabama, Alaska, California, Colorado, Connecticut, District of Columbia, Florida, Georgia, Hawaii, Maryland, Massachusetts, New Jersey, New Mexico, New York, North Carolina*, Rhode Island, South Carolina, Tennessee, Texas,

Vermont, Virginia

First cousin marriage, not allowed:

Arkansas, Delaware, Idaho, Iowa, Kansas, Kentucky, Louisiana, Michigan, Minnesota, Mississippi, Missouri, Montana,

Nebraska, Nevada, New Hampshire, North Dakota, Ohio, Oklahoma, Oregon, Pennsylvania, South Dakota, Washington,

West Virginia, Wyoming

Allowed under special circumstances:

As you can see, there are many states where marriage between first cousins is not allowed, but a significant number of states allow it, so it depends on what state your cousin lives in. Conversley, as another member stated in a post above, it looks like marriage among first cousins is not allowed in the Phillipines. So marrying her there is not an option at all. Yes, consult with an attorney for further clarification and advice.
