Happy Wednesday everyone! Sorry if this been addressed previously but I can't seem to find the answer. My fiance is from London and we received our NOA1 on 1/29/2018. We obviously wanted to get the NOA2 as soon as possible but we have just recently found out that his mom has cancer so there actually isn't as big of a rush anymore to get here so he can spend as much time with her as possible (it's not looking great). So my question would be after receiving the NOA2, is there a certain amount of time to take the next steps before that expires? For example, if we wanted to wait until spring of next year before pursuing the interview would that be an option?

The medical is only good for 1 year, the NOA2 is only valid about 4 month and you have to schedule the interview in that interval. You have after the interview about 6 month to get into the USA under K-1

10/21/2018                Card was mailed to me, and yes it said so on a Sunday night, while Vj-ing

10/22/2018                Card was picked up by the USPS

10/24/2018                EAD in hand. F%^&& finally

12/28/2018                Interview has been scheduled. Waiting for notification with date by snail mail

I think you can request to have it extended.

*the NOA2* if need be but mine was April 13th (NOA2) and the expiration is August 12th but like the person said above. I believe you have a good bit of time after receiving it to leave. Just don't let him come over on it and then go back until the permission to travel is received...good luck and wishing him happy times with her. Cancer is a POS.

This is London specific information and is accurate:

 

Your NOA2 will have a 4 month expiration. That is not a concern because If he is not able to interview before the expiration date, you simply write a new letter of intent for him to bring to his interview in London and your petition approval is extended.  That easy.

 

You may stall the London part of the process for one year. After maybe six months of nothing from him (DS-160 visa application) the embassy may write or email asking if he is still wanting a K1 visa. He can reply "yes, but...." and explain. He can slowly trickle things in. Submit the DS-160 before six months so they know he is still interested, but don't pick an interview date immediately.

 

Do not schedule a medical until closer to interview because it is good for six months. His time to move over starts ticking down from the date of the medical.  If he had a medical and waited five months to interview, his visa would be issued to expire in a month. (Six months from medical). He could return to London to the clinic and get the expired parts of the medical evaluation renewed, but that is extra expense and possibly travel if he can avoid it. 

 

Once the case passes from USCIS to NVC and reaches London, you are in control of the clock. 

 

Cancer is unpredictable and the initial diagnosis makes your thoughts go out of control. With time you will know more about the situation and how best to manage your immigration situation.

Thank you all for the great advise! After talking it over, we are going to cancel the K1 Visa and reapply for a K3 spouse visa. That way when he does get here, we won't get tied up with the AOS process. The last thing we'd want is for something to happen with his mum once he's here and him not be able to fly back home (well more accurately, not be able to get back in to the US).
